To the defendants above named, and any other person who may be concerned. You are notified that you have been sued in the Court above named. The nature of the suit against you is the foreclosure of a mortgage upon the property legally described as follows: Part of the Northwest Quarter of the Northwest Quarter of Section Thirty-two (32), Township Ten (10) North, Range Two (2) East, more particularly described as follows: Beginning at the Southwest corner of said Quarter Quarter Section and running North thirty-six (36) degrees, twenty-eight (28) minutes West, three hundred eighty-four and forty-five hundredths (384.45) feet; thence North fifty-four (54) degrees, one (1) minute East sixty-seven (67) feet; thence North fifty-seven (57) degrees, thirty-two (32) minutes East fifty (50) feet; thence North sixty-two (62) degrees fifty-five (55) minutes East fifty (50) feet; thence North seventy-one (71) degrees thirty (30) minutes East fifty (50) feet; thence North seventy-eight (78) degrees twenty-two (22) minutes East eighty-seven (87) feet to the Southwest corner, the point of beginning for the tract of real estate described herein; thence North Eleven (11) degrees thirty-eight (38) minutes West one hundred twenty-nine and sixty-five hundredths (129.65) feet; thence North eighty-eight (88) degrees twenty-four (24) minutes East seventy-five (75) feet; thence South eleven (11) degrees twenty-eight (28) minutes East one hundred thirty-one and seventy-four hundredths (131.74) feet; thence North eighty-nine (89) degrees fifty-eight (58) minutes West seventy-five (75) feet to the point of beginning, containing 0.22 acres, more or less, Brown County, Indiana. Commonly known as: 4980 Aqua Isle, Nashville, IN 47448-8866. This summons by publication is specifically directed to the following defendant(s) whose whereabouts are unknown with their last known address as follows: James T. Millay 4964 2nd Street Nashville, IN 47448-8412. In addition to the above-named defendants being served by this summons, there may be other defendants who have an interest in this lawsuit. An answer or other appropriate response in writing to the Complaint must be filed either by you or your attorney with the Clerk of the Court for Brown County at: Clerk of Brown County, Courthouse, P.O. Box 85, Nashville, IN 47448, (812) 988-5510 on or before the 21st day of September, 2011, (the same being thirty (30) days after the Third Notice of Suit), and if you fail to do so a judgment may be entered against you for what the plaintiff has demanded.
