The State of Indiana to the Defendant(s) above named,
and any other person who may be concerned.
You are hereby notified that you have been sued
in the Court above named. The nature of the suit against you is:
Complaint on Note and to Foreclose Mortgage on
Real Estate against the property commonly known
as 9604 Calvin Cemetery Rd, Trafalger, IN 46181-9442
and described as follows: Part of the fractional
Southeast quarter of the Northwest quarter, and part
of the fractional Southwest quarter of the Northeast quarter
of Section 3, Township 10 North, Range 3 East,
Hamblen Township, Brown County, Indiana,
described as follows: Beginning North 88 degrees 36 minutes 19 seconds
East 435.36 feet and South 10 degrees 28 minutes 12 seconds
West 178.5 feet from the Northwest corner of the fractional
Southeast quarter of the Northwest quarter of said Section 3;
thence South 71 degrees 41 minutes 39 seconds East 1495.13
feet to the center of a 40-foot wide easement for ingress,
egress and utilities; thence South 00 degree 39 minutes
East with the center of said easement 152.5 feet;
thence North 71 degrees 41 minutes 39 seconds
West 1524.8 feet; thence North 10 degrees 28 minutes 12 seconds
East 145.59 feet to the beginning, containing 5.0 acres,
more or less. Subject to the right of ingress and
egress to and from Cemetery commonly called
“Calvin Cemetery” running through subject real estate.
This summons by publication is specifically directed to
the following named defendant(s): Roy B. Callon,
Fifth Third Bank d/b/a Fifth Third Bank (Central Indiana),
HSBC Bank Nevada NA and State of Indiana.
This summons by publication is specifically directed
to the following named defendant(s) whose whereabouts
are unknown: GE Capital Financial, Inc.. If you have a claim
for relief against the plaintiff arising from the same
transaction or occurrence, you must assert it in your
written answer or response. You must answer the Complaint
in writing, by you or your attorney, within (30) days after
the Third Notice of Suit, and if you fail to do so a judgment
by default may be entered against you for the relief demanded, by the Plaintiff.
