By virtue of a certified copy of a decree to me directed from the Clerk of the Circuit Court of Brown County, Indiana, in Cause No. 07C01-1009-MF-0523 wherein Fifth Third Mortgage Company was Plaintiff, and Erik A. Engdahl, Occupant(s) of 5998 N Bear Creek Road, Morgantown, IN 46160, Fifth Third Bank (Central Indiana) and The State of Indiana through its Department of Revenue, were the Defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 12th day of May, 2011, at 10:00 A.M. of said day, at the 55 State Road 46 East, Nashville, IN 47448, the fee simple of the whole body of Real Estate in Brown County, Indiana: All that part of the South half of the Southeast quarter of the Southeast quarter of Section 19, Township 10 North, Range 2 East, lying West of the center line of the Bear Creek Public Highway as presently located and established, and more particularly described by Survey made by Robert Allen, Registered Land Surveyor #S0078 as follows: A part of the Southeast quarter of the Southeast quarter of Section 19, Township 10 North, Range 2 East, described as follows: Beginning at the Southwest corner of said quarter quarter section; thence North 696.6 feet; thence East 1158.8 feet; thence Southwesterly with the center of a Public Road 763.9 feet; thence West 908.6 feet to the beginning, containing 17.2 acres, more or less. 005-00600-17 and commonly known as: 5998 N Bear Creek Road, Morgantown, IN 46160. Subject to all easements and restrictions of record not otherwise extinguished in the proceedings known as Cause # 07C01-1009-MF-0523 in the Circuit Court of the County of Brown Indiana, and subject to all real estate taxes, and assessments currently due, delinquent or which are to become a lien. Said sale will be made without relief from valuation or appraisement laws. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee's Attorney.
