NOTICE OF SHERIFF'S SALE

TO THE OWNERS OF THE WITHIN DESCRIBED REAL ESTATE AND ALL INTERESTED PARTIES:

 

By virtue of a certified copy of a decree to me directed from the Clerk of the Circuit Court of Brown County, Indiana, in Cause No. 07C01-1008-MF-0483, wherein M & I Bank, FSB was plaintiff and G. Warren Cole, et. al., were the defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 12th day of May, 2011, at the hour of 10:00 A.M. or as soon thereafter as is possible, at 55 State Road 46, Box 95, Nashville, Indiana 47448, the fee simple of the whole body of real estate in Brown County, Indiana: Lot Number Seven (No. 7) in Johnson Addition, a subdivision of a part of the South Half of the North Half of Section 13, Township 9 North, Range 2 East; and a part of the Southwest Quarter of the Northwest Quarter of Section 18, Township 9 North, Range 3 East, according to the plat thereof as recorded in Miscellaneous Record No. 7 on page 46 and 47, in the Office of the Recorder of Brown County, Indiana.  Also, a part of Lot Numbered Six (No. 6) in said Johnson Addition, more particularly described as follows: Beginning at the Northwest corner of Lot 6 in said Addition; thence South 60 degrees East 369.5 feet to an iron pipe located in the East boundary line of Lot No. 6; thence in a Northeasterly direction along said boundary line North 54 1/2 degrees East 126.2 feet to the North boundary line of Lot No. 6, which is the South boundary line of Lot No. 7; thence along said boundary line in a Northwesterly direction North 74 degrees West 439 feet to the place of beginning, containing one-half of an acre, more or less.  Also, the following part of Lot Numbered Six (No. 6) in said Johnson Addition, more particularly described as follows: Beginning at the Northwest corner of Lot Numbered Six (No. 6); thence along the Southwest boundary line of said Lot No. 6, in a Southeasterly direction, South 9-1/4 degrees East 67.3 feet to a point in the South boundary line of a Private Road leading to Lot No. 7 in said Addition; thence along the South line of said Private Road North 60-3/4 degrees East to a point in Lot No. 6 in the South line of part of Lot No. 6, heretofore, to-wit: on May 17, 1949 conveyed by Fred B. Johnson et. ux., to Walter H. Judd, Jr., et. ux., being a distance of approximately 82 feet; thence in a Northwesterly direction, North 60 degrees West to the point of beginning, containing a fraction of an acre. The above real estate more accurately described by survey of Robert Allen, Registered Land Surveyor No. S0078, dated August, 1975, as follows: Lot Number Seven (No. 7) and a part of Lot Number Six (No. 6) in Johnson Addition, Brown County, Indiana, described as follows: Beginning at the Northeast corner of said Lot No. 7; thence South 42 degrees 26 minutes West 199.6 feet; thence South 57 degrees 00 minutes West 126.2 feet; thence North 53 degrees 43 minutes West 274.9 feet; thence South 68 degrees 40 minutes West 82 feet; thence North 03 degrees 14 minutes West 89.8 feet, thence North 15 degrees 15 minutes West 58.5 feet; thence North 43 degrees 55 minutes East 273.7 feet; thence South 49 degrees 29 minutes East 271.7 feet; thence South 62 degrees 48 minutes East 182.8 feet to the beginning, along with the ingress and egress easement as set forth in a Warranty Deed dated May 17, 1949, and recorded May 19, 1949 in Deed Record no. 58 on page 221, in the Office of the Recorder of Brown County, Indiana.  More Commonly known as: 1547 State Road 135 N, Nashville, IN 47448. Parcel No. 07-07-18-100-154.000-004, 07-07-18-100-156.000-004. Together with rents, issues, income, and profits thereof, said sale will be without relief from valuation or appraisement laws.
