NOTICE OF SHERIFF'S SALE

TO THE OWNERS OF THE WITHIN DESCRIBED REAL ESTATE AND ALL INTERESTED PARTIES

NOTICE OF SHERIFF'S SALE

By virtue of a certified copy of a decree to me directed from the Clerk of Circuit Court of Brown County, Indiana, in Cause No. 07C070912MF0682 wherein Beneficial Indiana, Inc., d/b/a Beneficial Mortgage Co. was Plaintiff, and Ila I. McCoy, et al., were the Defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 9th day of March, 2011, at the hour of or soon after 10:00 am of said day at the Brown County Sheriff's Department the fee simple of the whole body of real estate in Brown County, Indiana: A part of the northwest quarter of the northwest quarter of section 34, township 10 north, range 2 east, Jackson Township, Brown County, Indiana, described as follows: Beginning at a railroad spike at the northwest corner of said quarter quarter section, thence with the north line of said quarter quarter section north 90 degrees 00 minutes 00 seconds east 210.0 feet; thence south 00 degrees 53 minutes 09 seconds west 557.95 feet to the north right of way line of the Illinois Central Railroad; thence with the railroad right of way along a curve to the right, a distance of 211.71 feet to an iron pin on the west line of said quarter section, said curve having a radius of 2953.64 feet and a long chord with a bearing and length of north 82 degrees 09 minutes 45 seconds west 211.53 feet; thence north 00 degrees 53 minutes 09 seconds east with said west line 529.11 feet to the beginning, containing 2.64 acres, more or less. (Also identified as the west tract on McCoy Minor Plat recorded July 30, 1990 in Plat Book No. 3 on page 15 as Instrument No. 90-2256, in the office of the Recorder of Brown County, Indiana). Subject to the right of way of State Road No. 45 along the northerly line of subject real estate. Subject to any utility easements, roads or right of way, existing or of record, affecting said real estate. This conveyance is made for the purpose of setting off the above parcel of real estate separately from the balance of Grantors' real estate to comply with the Brown County Zoning Rules and Regulations. Parcel No. 005-0307-19. Commonly known as: 2981 State Road 45, Nashville, IN 47448. Together with rents, issues, income, and profits thereof, said sale will be made without relief from valuation or appraisement laws. All sales are subject to any first and prior liens, taxes and assessments legally levied and assessed thereon. Neither the Sheriff nor the Plaintiff in this case warrants either expressly or implied any title, location or legal description of any real estate sold at the sale. Any prospective bidders should obtain their own title evidence before making any bid on any properties subject to this sale.
