Notice is hereby given that Verizon Wireless has filed with the Area Board of Zoning Appeals of the County of Brown, Indiana, an application for a Special Exception for a Wireless Communication Facility as provided for in the Brown County Zoning Ordinance, to wit: Legal description of premises: A part of the East half of the Southwest quarter of Section 27, Township 10 North, Range 2 East, more particularly described as follows: Beginning at a point in the West line of said East half of the Southwest quarter of Section 27, Township 10 North, Range 2 East, 34 rods South of the Northwest corner; thence South along said West line 90 rods to a point; thence North 86 degrees East 844 feet to a point; thence South 13 degrees East 300 feet along the foot of the hill; thence South 2 degrees West along the center of Lick Creek 382 feet to the South line of said East half of the Southwest quarter; thence East 448 feet to a point; thence North along the East line of said East half of the Southwest quarter a distance of 114 rods to point; thence in a Northwesterly direction 80 rods to the point of beginning, containing 48 acres, more or less. Part of the East half of the Southwest quarter of Section 27, Township 10 North, Range 2 East, Jackson Township, Brown County, Indiana, described as follows: Commencing at the Northwest corner of the East half of the Southwest quarter of said Section 27; thence South 00 degrees 00 minutes 00 seconds East (bearing from Strong, Registered Land Surveyor No. 9234) on and along the West line of said East half of the Southwest quarter 561.00 feet to the most Northerly corner of a tract described to Bond in Deed Record Number 103, page 324, in the office of the Recorder of Brown County, Indiana; thence South 82 degrees 29 minutes 30 seconds East with the North line of Bond 933.00 feet to the beginning; thence continuing South 82 degrees 29 minutes 30 seconds East with said North line 240.00 feet; thence the following three (3) courses are through the lands of Bond; South 07 degrees 30 minutes 30 seconds West 690.00 feet, North 82 degrees 29 minutes 30 seconds West 240.00 feet, and North 07 degrees 30 minutes 30 seconds East 690.00 feet to the beginning, containing 3.802 acres, more or less. ALSO, the right of ingress and egress over an existing driveway running Westerly from Lick Creek County Road to the South line of the above described 3.802-acre tract. Applicant is requesting a Special Exception for a Wireless Communication Facility. The property is located on the West side of Lick Creek Road and North of State Road 45 in Jackson Township. The file on this matter is available for public inspection during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana until two days prior to the hearing date. A public hearing will be held by the Board on August 25, 2010 during a meeting commencing at 6:00 p.m. All interested persons will be given the opportunity to be heard in reference to the matters set out in the application. This notice is being published to notify persons affected by this application by order of the Area Board of Zoning Appeals. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time. The meeting will be held in the second floor meeting room of the County Office Building, Nashville, Indiana.
