Notice is hereby given that Hickory Shades, LLC, has filed with the Area Plan Commission of the County of Brown, Indiana, an application for Rezoning of property, to wit: Legal description of premises: A part of the Northwest Quarter of the Southeast Quarter of Section 6, Township 8 North, Range 2 East, Brown County, Indiana, described as follows: Beginning South 2 degrees 6' West 1048.4 feet from the Northwest corner of said quarter quarter section; thence South 84 degrees 57' East 214.8 feet; thence South 2 degrees 6' West 203.0 feet; thence North 84 degrees 57' West 214.8 feet; thence North 2 degrees 6' East 203.0 feet to the beginning. Containing 1 acre, more or less. It is understood and agreed by the parties hereto that the title to the real estate herein conveyed is warranted only insofar as it might be affected by any act of the grantor during its ownership and not otherwise. Subject to any and all easements, assessments, agreements, and restrictions of record. The undersigned persons executing this deed on behalf of Grantor represent and certify that they are duly elected officers of Grantor and have been fully empowered, by proper resolution of the Board of Directors of Grantor, to execute and deliver this deed; that Grantor has full corporate capacity to convey the real estate described herein; and that all necessary corporate action for the making of such conveyance has been taken and done. Applicant is requesting approval for rezoning the described property from Residential (R1) to General Business (GB). The property is located at 5714 State Road 46 West in Washington Township. The file on this matter is available for public inspection at least 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana. The Commission will hold a public hearing on August 24, 2010 during a meeting commencing at 6:00 p.m. All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. This notice is being published to notify persons affected by this petition by order of the Area Plan Commission. Written comment regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing will be considered. The hearing may be continued from time to time. The meeting will be held in the second floor meeting room of the County Office Building, Nashville, Indiana.
