NOTICE OF SHERIFF’S SALE


By virtue of a certified copy of a decree to me directed from the Clerk of Brown Circuit Court of Brown County, Indiana, in Cause No. 07C01-1002-MF-0065 wherein Citizens Bank f/k/a Republic Bank was Plaintiff, and Carey Briggs a/k/a Carey A. Briggs and Dalene L. Briggs were Defendants, required me to make the sum as provided for in said Decree with interest and cost, I will expose at public sale to the highest bidder, on the 25th day of August, 2010, at the hour of 10:00 a.m., or as soon thereafter as is possible, at 55 State Rd 46 East, Nashville, IN 47448, the fee simple of the whole body of Real Estate in Brown County, Indiana. Part of Lot No. 14 in Timbercrest Subdivision, as recorded in Plat Book 2, page 27, in the Office of the Recorder of Brown County, Indiana, described as follows: Beginning at a capped rebar set in the north line of Lot 14 in said Timbercrest Subdivision, North 88 degrees 22 minutes East (assumed bearing) 225.0 feet from a rebar found marking the northwest corner of said Lot No. 14; thence North 88 degrees 22 minutes East with said North line 230.3 feet to a capped rebar set; thence South 01 degrees 37 minutes East 1334.7 feet to a capped rebar set in the South line of said Lot No. 14; thence South 89 degrees 19 minutes West with said South line 69.6 feet to a capped rebar set; thence North 01 degrees 37 minutes West 300.0 feet to a capped rebar set; thence north 31 degrees 08minutes West 319.6 feet to a capped rebar set; thence North 01 degrees 52 minutes West 755.4 feet to the beginning. Containing 5.39 acres, more or less. More commonly known as 2038 Timber Crest Rd, Nashville, IN 47448-8527. Parcel No. 003-01640-26. Together with rents, issues, income, and profits thereof, said sale will be made without relief from valuation or appraisement laws.
