NOTICE OF SHERIFF’S SALE
By virtue of a certifi ed copy of a Judgment and
Decree-Order of Sale directed to me from the
Clerk of the Brown Circuit Court in Cause No.
07C01-0905-MF-0275, on the docket of the
Brown Circuit Court wherein Jackson County
Bank is Plaintiff and David L. Benson, Katherine
A. Benson and Treasurer, Brown County, Indiana,
are Defendants, I will offer for sale at public
auction to the highest bidder on the 6th day of
January, 2010, at 10:00 o’clock a.m., at the door
of the Sheriff’s Offi ce, Brown County, Indiana,
the following described real estate in Brown
County, Indiana. A part of the Southwest quarter
of the Southwest quarter of Section 20, Township
9 North, Range 4 East, Brown County, Indiana,
described as follows: Commencing at an iron pin
at the Southwest corner of the above described
Southwest quarter of the Southwest quarter of
Section 20; thence with the South line of the
quarter quarter North 89 degrees 17 minutes 35
seconds East, 735.07 feet to an iron pin; thence
North 01 degree 21 minutes 18 seconds West parallel
with the East line of the quarter quarter 800.0
feet to an iron pin and the true point of beginning
of the tract herein described; thence North 39 degrees
31 minutes 34 seconds West 486.57 feet to
the Southerly line of a 2.08 acre tract recorded
in Deed Record No. 86, page 359; thence with
the Southerly line of said 2.08 acre tract North 76
degrees 59 minutes 22 seconds East, 70.00 feet
to the Southwest corner of Lot No. 2 in Fanfort
Subdivision; thence with the South line of said
Subdivision along the following three (3) calls:
(1) South 88 degrees 00 minutes 29 seconds
East, 217.87 feet; thence (2) South 56 degrees
34 minutes 29 seconds East, 209.73 feet; thence
(3) North 80 degrees 08 minutes 31 seconds East,
177.16 feet; thence North 70 degrees 22 minutes
31 seconds East, 6.63 feet to the Southwest corner
of a 0.99 acre tract recorded in Deed Record
No. 151, pages 138-139; thence with the Southerly
line of said tract along the following two (2)
calls; (1) North 70 degrees 22 minutes 31 seconds
East, 159.47 feet; thence (2) North 69 degrees 38
minutes 31 seconds East, 115.73 feet to the East
line of the quarter quarter; thence with said East
line South 01 degree 21 minutes 18 seconds East,
387.06 feet to an iron pin located 800.00 feet
North of the Southeast corner of the quarter quarter;
thence South 89 degrees 17 minutes 35 seconds
West parallel to the South line of the quarter
quarter 600.00 feet to the point of beginning, containing
5.740 acres, more or less, together with
rents, issues, income and profi ts thereof. The Real
Estate has a street address of 7057 Jordan Lane,
Nashville, IN 47448. I will then and there offer at
public auction to the highest bidder the fee simple
title of David L. Benson and Katherine A. Benson
to the above-described real estate, subject to all
real estate taxes now due and assessed thereon, to
satisfy the decree rendered by the Brown Circuit
Court in Cause No. 07C01-0905-MF-0275 on the
docket of the Court, with interest and costs and to
carry out the order of sale issued in favor of Jackson
County Bank. The sale will be made without
relief of valuation or appraisement laws. Dated
this 20 day of November, 2009.
