NOTICE OF SHERIFF'S SALE
By virtue of a certified copy of a decree to me directed to me from the Clerk of the Circuit Court of Brown County, Indiana, in Cause No. 07C01-0910-MF-0577 wherein Fifth Third Mortgage Company was Plaintiff, and John N. Day and Beverly J. Day, were the Defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 30 day of June, 2010, at 10:00 A.M. of said day, at the 55 State Road 46 East, Nashville, IN 47448, the fee simple of the whole body of Real Estate in Brown County, Indiana: A part of the South half of the Northeast Quarter of Section 12, Township 10 North Range 2 east, in Brown County, Indiana, more particularly described as follows: Beginning 291.55 feet North and 33.00 feet East of the Southeast corner of the Southwest quarter of said Northeast quarter, thence East 462.0 feet thence North 294.20 feet; thence West 891.0 feet, more or less, to the centerline of state highway 135; thence Southwesterly on and along the centerline 198.0 feet thence East 462.0 feet thence South 96.53 feet to the point of beginning containing 5.21 acres more or less. 07-03-12-200-159.000-002, and commonly known as: 8563 N State Rd 135, Morgantown, IN 46160. Subject to all easements and restrictions of record not otherwise extinguished in the proceedings known as Cause # 07C01-0910-MF-0577 in the Circuit Court of the County of Brown Indiana, and subject to all real estate taxes, and assessments currently due, delinquent or which are to become a lien. Said sale will be made without relief from valuation or appraisement laws. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee's Attorney.
