SUMMONS – SERVICE BY PUBLICATION
The State of Indiana to the defendants above
named, and any other person who may be concerned.
You are notifi ed that you have been sued
in the Court above named. The nature of the suit
against you is: Foreclosure of the real estate
mortgage, which is legally described as: Exhibit
A, Legal Description, Parcel 004-0855-050. A
certain tract or parcel of land in Brown County, in
the State of Indiana, described as follows: A part
of the Northeast quarter of the Northwest quarter,
and a part of the Southeast quarter of the Northwest
quarter, all in Section 2, Township 9 North,
Range 3 East of the Second Principal Meridian,
in Hamblen Township, Brown County, Indiana,
described as follows: Beginning at a point on the
South line of said Northeast quarter of the Northwest
quarter section in a Public Road 510.50 feet
North 84 degrees 34 minutes 23 seconds West
(assumed bearing) from the Southeast corner
thereof; thence South 67 degrees 10 minutes
West 450.00 feet; thence North 25 degrees 20
minutes West 247.84 feet to a point in a Private
Road; thence North 67 degrees 10 minutes East
328.89 feet with last said Road; thence North 48
degrees 32 minutes East 138.50 feet with last said
Road; thence South 22 degrees 58 minutes East
with said Public Road 291.85 feet to the Place of
Beginning, containing 2.65 acres, more or less.
(Designated as Tract “A” on an unrecorded plat
of a survey certifi ed July 3, 1975 by Gilmore C.
Abplanalp, Registered Land Surveyor No. 9792).
Subject to all easements, roads or rights of way
existing or of record, affecting said real estate.
The acreage indicated in this legal description
is solely for the purpose of identifying said tract
and is not to be construed as to insuring the quantity
of land. This property is commonly known
as 4375 O Henry Lane, Nineveh, IN 46164. This
summons by publication is specifi cally directed
to the following defendants whose addresses are:
none. And to the defendant whose whereabouts
are unknown: Marianna Fisher. In addition to the
above named defendants being served by this
summons there may be other defendants who
have an interest in this lawsuit. If you have a
claim for relief against the plaintiff arising from
the same transaction or occurrence, you must assert
it in your written answer. You must answer
the Complaint in writing, by you or your attorney,
on or before the 11th day of December, 2009
(the same being within thirty (30) days after the
Third Notice of Suit), and if you fail to do so, a
judgment will be entered against you for what the
plaintiff has demanded.
