NOTICE OF SUIT
The State of Indiana to the Defendants above
named, and any other person who may be concerned:
You are notifi ed that you have been sued
in the Court above named. The nature of the suit
against you is a Complaint on Note and for Foreclosure
of Mortgage on the following described
real estate: A part of the east half of the northeast
quarter of Section 28, Township 8 North, Range
4 East, Brown County, Indiana, more particularly
described as follows: Commencing at a found iron
pin at the southwest corner of said East half; thence
along the south line of said East half and subsequently
along or near the approximate centerline
of County Road, north 89 degrees 59 minutes 22
seconds East (an assumed bearing) 402.00 feet to
a set iron pin; thence leaving said south line, North
00 degrees 00 minutes 34 seconds west 1,366.00
feet to a set iron pin at the point of beginning of this
description; thence continuing north 00 degrees 00
minutes 34 seconds west 260.00 feet to a set iron
pin; thence north 89 degrees 59 minutes 22 seconds
east 476.42 feet to a set iron pin; thence south 18 degrees
42 minutes 02 seconds east (passing through
a set iron pin at 387.65 feet) 431.65 feet to a PK
nail in the approximate centerline of Becks Grove
Road, thence along or near the approximate center
of said Becks Grove Road the following courses;
south 65 degrees 33 minutes 24 seconds west 7.92
feet to a set PK Nail; thence south 19 degrees 04
minutes 26 seconds west 76.54 feet to a set PK
Nail; thence south 11 degrees 16 minutes 14 seconds
east 68.37 feet to a set PK nail; thence leaving
said road, north 63 degrees 56 minutes 15 seconds
west (passing through set iron pins at 20.75 and
209.69 feet) 663.36 feet to the point of beginning,
containing 5.068 acres, more or less, subject to all
legally established rights of way and easements.
And commonly known as: 6150 Becks Grove
Road, Columbus, IN 47201. This Summons by
Publication is specifi cally directed to the following
named Defendants whose whereabouts are known
to me: Roy Fish, Michael A. Millhoff, Heartland
Community Bank and United States of America
through the Department of Housing and Urban Development.
This Summons by Publication is also
specifi cally directed to the following named Defendants
whose whereabouts are unknown to me:
Tegon D. Sellers. In addition to the above named
Defendants being served by this Summons, there
may be other Defendants who have an interest in
this lawsuit. If you have a claim for relief against
the Plaintiff arising from the same transaction or
occurrence, you must assert it in your written answer.
You must answer the Complaint in writing,
by you or your attorney, on or before the 19th day
of March, 2010 (the same being within thirty (30)
days after the Third Notice of Suit), and if you fail
to do so, a judgment will be entered against you for
what the Plaintiff has demanded.
