NOTICE OF SUIT
The State of Indiana to the above-named defendants,
and any other person who may be concerned.
You are notifi ed that you have been sued
in the above-named Court. The nature of the suit
against you is: Complaint on Note and to Foreclose
Mortgage on the following described real estate
in Brown County: A part of the southwest quarter
of the northeast quarter of section 9, Township 9
north, range 3 east, more particularly described as
follows: Beginning at a point 841.5 feet north and
140.25 feet east of the southwest corner of said
quarter quarter section, which point is in the center
of a county road; thence following the center of
said road north 17 degrees east 73.5 feet; thence
north 28 degrees east 91.5 feet; thence leaving said
road and running south 75 degrees west 157 feet;
thence west 299 feet to the point of beginning, containing
1 acre more or less. All more accurately described
as follows: Part of the southwest quarter of
the northeast quarter of section 9 township 9 north,
range 3 east, Hamblen Township, Brown County,
Indiana, described as follows: Commencing at the
southwest corner of the southwest quarter of the
northeast quarter of said section 9; thence north 00
degrees 34 minutes 47 seconds east (bearing from
adjoiner deed) on and along the west line of said
southwest quarter, northeast quarter 841.50 feet;
thence south 87 degrees 12 minutes 35 seconds
east 122.70 feet to the center of Lawson Ridge
County Road and the beginning; thence the following
three (3) courses are with the center of said
county road; north 24 degrees 43 minutes 27 seconds
east 13.66 feet, north 22 degrees 41 minutes
29 seconds east 52.84 feet and north 30 degrees 04
minutes 10 seconds east 98.38 feet; thence leaving
the center of said county road south 88 degrees 40
minutes 24 seconds east 247.50 feet; thence south
08 degrees 51 minutes 35 seconds west 157.00
feet; thence north 87 degrees 12 minutes 35 seconds
west 299.00 feet to the beginning, containing
0.965 acre more or less (calculated). This Summons
by publication is specifi cally directed to the
following named defendants whose addresses are:
Option One Mortgage Corporation, c/o Highest
Executive Offi cer Present, 1820 East First Street,
Santa Ana, CA 92705; United States of America,
c/o Timothy M. Morrison, United States Attorney
for the Southern District of Indiana, 10 W. Market
Street, Suite 2100, Indianapolis, IN 46204; The
Hark Heraldry Inc, c/o Highest Executive Offi cer
Present, 1119 Caroline Street, Fredericksburg, VA
22401; and to the following named defendants
whose whereabouts are unknown: David V. Fay a/
k/a David Fay, Sarah S. Fay a/k/a Sarah Fay. In addition
to the above-named defendants being served
by this summons there may be other defendants
who have an interest in this law suit. If you have a
claim for relief against the plaintiff arising from the
same transaction or occurrence, you must assert it
in your written answer. You must answer the Complaint
in writing, by you or your attorney, on or before
March 19, 2010 (the same being within thirty
(30) days after the Third Notice of Suit), and if you
fail to do so a judgment will be entered against you
for the what the plaintiff has demanded.
