NOTICE OF SHERIFF’S SALE
By virtue of a certifi ed copy of a decree to me directed
to me from the Clerk of the Circuit Court
of Brown County, Indiana, in Cause No. 07C01-
0906-MF-0367 wherein CU Members Mortgage,
a division of Colonial Savings, F.A. was Plaintiff,
and Judith A. Lucas and Clarence D. Lucas, were
the Defendants, requiring me to make the sum as
provided for in said Decree with interest and costs,
I will expose at public sale to the highest bidder, on
the 24 day of March, 2010, at 10:00 A.M. of said
day, at the 55 State Road 46 East, Nashville, IN
47448, the fee simple of the whole body of Real
Estate in Brown County, Indiana: A part of the west
half of the northeast quarter of section 24, township
10 north, range 2 east of the second principal meridian
in Brown County, Indiana, more particularly
described as follows: Beginning at the northwest
corner of said half quarter section; thence north 89
degrees 57 minutes 23 seconds east 193.39 feet (9
rods by deed) to the centerline of a creek (as now
located and established); thence the next ten (10)
calls being along said centerline; 1.) thence south
31 degrees 56 minutes 36 seconds east 43.07 feet;
2.) thence south 59 degrees 54 minutes 11 seconds
east 54.55 feet; 3.) thence south 26 degrees 35 minutes
55 seconds east 169.89 feet; 4.) thence south

west 76.99 feet to a 5/8 inch rebar with cap set;

west 50.43 feet to the southeast corner of a tract of
land conveyed to James and Julie Hawley, as described
in a “Warranty Deed” dated October 28th,
1988 and recorded in Deed Record 141, page 89
through 90 in the offi ce of the Recorder of Boone
County, Indiana and to a rebar found; thence north
00 degrees 15 minutes 18 seconds west along the
east line of said tract 437.45 feet to a rebar found;
thence south 89 degrees 10 minutes 58 seconds
west along the north line of said tract 205.14 feet
to the northwest corner of said tract and to a point
of the east line of a tract of land conveyed to Wayne
e/ and Lois Jean Weber, as described in a “Warranty
Deed” dated October 10, 1969, and recorded as Instrument
Number 7074 in said offi ce in said county
and to a 5/8 inch rebar with cap set; thence north 00
degrees 15 minutes 45 seconds west along said east
line 907.32 feet to the northeast corner of said tract
and to a point on the north line of the east half of
the northwest quarter of said section 24 to a 5/8 inch
rebar with cap set; thence north 89 degrees 59 minutes
42 seconds east along said north line 349.36
to the point of beginning, containing 18.242 acres,
more or less and commonly known as: 6754 North
Railroad Road, Morgantown, IN 46160-8921. Parcel
No. 07-03-24-200-109.000-002. Subject to all
easements and restrictions of record not otherwise
extinguished in the proceedings known as Cause #
07C01-0906-MF-0367 in the Circuit Court of the
County of Brown Indiana, and subject to all real
estate taxes, and assessments currently due, delinquent
or which are to become a lien. Said sale will
be made without relief from valuation or appraisement
laws. If the sale is set aside for any reason,
the Purchaser at the sale shall be entitled only to
a return of the deposit paid. The Purchaser shall
have no further recourse against the Mortgagor, the
Mortgagee, or the Mortgagee’s Attorney.
