SPECIAL EXCEPTION AREA BOARD OF ZONING APPEALS

Notice is hereby given that Freedom Park, LLC, Petitioner, has filed with the Board of Zoning Appeals of the County of Brown, Indiana, an application for a Special Exception

Legal description of premises:

The Northwest quarter of the Southeast quarter and part of the Southwest quarter of the Southeast quarter of Section 30, Township 10 North, Range 3 East of the second principal median, also part of the Northwest quarter of the Northeast quarter of Section 31, Township 10 North, Range 3 East of the second principal meridian all in Jackson Township, Brown County, Indiana described as follows:

Beginning at a 3/4 inch (inside diameter) iron pipe found marking the Northeast corner of the Northwest quarter of the Southeast quarter of said section 30: thence South 00° 38' 45" East (Bearing from adjoining survey) 1331.76 feet to a 1 inch (inside diameter) iron pipe found marking the Southeast corner of said Northwest quarter, Southeast quarter of said section 30; thence South 00° 57* 06" East 1364.75 feet to a 5/8” capped rebar found marking the Southeast corner of said Southwest quarter, Southeast quarter of said Section 30, also the Northeast corner of the Northwest quarter of the Northeast quarter of said Section 31; thence South 00° 44' 24” East on and along the East line of said Northwest quarter, Northeast quarter 395.59 feet to a 5/8" capped rebar (Stamped Bennett S0438)set; thence North 89° 38'47*' West 290.64 feet to a 5/8” capped rebar (Stamped Bennett S043) set; thence South 00° 2 P 13” West 595.00 feet to a 5/8" capped rebar (Stamped Bennett S043) set; thence North 89° 38'47" West 85.93 feet to a 5/8” rebar found; thence South 00° 21' 13" West 175.00 feet to a 2” mag nail with aluminum disc (Stamped Bennett S0438) set in the center of Gatesville County Road; thence North 88° 42’46" West with the center of said county road 152.63 feet to a 2 inch mag nail with aluminum disc (Stamped Bennett S043) set; thence leaving the center of said county road North 00° 51' 19" West 2519.17 feet to a 5/8" capped rebar (stamped Bennett S0438) set on the South line of said Northwest quarter. Southeast quarter; thence South 89° 25’ 29" West on and along said South line 800.51 feet to a 1/2" (inside diameter) iron pipe found marking the Southwest corner of said Northwest quarter; Southeast quarter thence North 00° 14' 22" West 1333.32 feet to a 1 1/2 inch (inside diameter) iron pipe found marking the Northwest comer of said Northwest quarter. Southeast quarter, thence North 89° 29’ 27" East 1334.82 feet to the beginning, containing 66.959 acres more or less.

Tract A:    Part of the Southeast quarter of the Southeast quarter of Section 30, Township 10 North, Range 3 East of the Second Principal Meridian, Jackson Township, Brown County, Indiana, described as follows:

Beginning at the Northwest corner of the Southeast quarter of the Southeast quarter of said Section 30; thence South 90 degrees 00 minutes 00 seconds East on and along the North line of said Southeast quarter of the Southeast quarter 602.25 feet; thence South 00 degrees 20 minutes 40 seconds East 578.63 feet; thence North 90 degrees 00 minutes 00 seconds West 602.25.25 feet to the West line of said Southeast quarter of the Southeast quarter; thence North 00 degrees 20 minutes 39 seconds West on and along said West line 578.63 feet to the beginning containing 8.00 acres, more or less.

Tract B:   A fifty (50) foot wide perpetual, non-exclusive easement for ingress, egress, road way and utilities located in part of the Northeast quarter of Section 31, Township 10 North, Range 3 East of the Second Principal Meridian, Jackson Township, Brown County, Indiana, lying to the right of the following described line; Commencing at the Northwest corner of the Northeast quarter of the Northeast quarter of said Section 31; thence North 89 degrees 23 minutes 49 seconds East on and along the North line of said Northeast quarter of the Northeaster quarter 602.25 feet to the beginning;thence South 00 degrees 07 minutes 35 seconds East 1185.21 feet to the center of Gatesville County Road and the terminus of said fifty (50) foot wide easement The sidelines of said fifty (50) foot wide easement are to be extended or shortened to meet at angle points.

Tract C:    A fifty (50) foot wide perpetual, non-exclusive easement for ingress, egress, roadway and utilities located in part of the Southeast quarter of the Southeast quarter of Section 30, Township 10 North, Range 3 East of the Second Principal Meridian, Jackson Township, Brown County, Indiana, lying to the left of the following described line; Commencing at the Southwest comer of the Southeast quarter of the Southeast quarter of said Section 30; thence North 89 degrees 23 minutes 49 seconds East on and along the South line of said Southeast quarter of the Southeast quarter 602.25.25 feet to the beginning; thence North 00 degrees 20 minutes 40 seconds West 779.78 feet to the North line of a 10.825 acre tract and the terminus of said fifty (50) foot wide easement The sidelines of said fifty (50) foot wide easement are to be extended or shortened to meet at angle points.

ALSO    Part of the Southeast quarter of the Southeast quarter of Section 30 Township 10 North, Range 3 East of the Second Principal Meridian, Jackson Township, Brown County, Indiana described as follows: Beginning at the Southwest corner of the Southeast quarter of the Southeast quarter of said Section 30; thence North 00 degrees 20 minutes 39 seconds West on and along the West line of said Southeast quarter, Southeast quarter 786.12 feet; thence South 90 degrees 00 minutes 00 seconds East 299.09 feet; thence South 15 degrees 34 minutes 47 seconds 815.27 feet to the South line of said Southeast quarter, Southeast quarter; thence South 89 degrees 23 minutes 49 seconds West on and along said South line 75.41 feet to the beginning, containing 3.376 acres more or less. Subject to all legal rights of way and easements existing or of record affecting said real estate.

Applicant is requesting a Special Exception for a public camp. The property is located on Gatesville Road and approximately .40 mile East of State Road 135 North in Jackson Township.

The file on this matter is available for public inspection during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana, until two days prior to the hearing date.

A public hearing will be held by the Board on April 23, 2014 during a meeting commencing at 6:00 p.m. All interested persons will be given the opportunity to be heard in reference to the matters set out in the application. This notice is being published to notify persons affected by this application by order of the Area Board of Zoning Appeals. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time. The meeting will be held in the second floor meeting room of the County Office Building, Nashville, Indiana.
