NOTICE OF SHERIFF'S SALE

By virtue of a certified copy of a decree to me directed from the Clerk of the Circuit Court of Brown County, Indiana, in Cause No. 07C01-1303-MF-000116, wherein PHH Mortgage Corporation was Plaintiff, and Stewart B. Turner-Ball, et. al., were the Defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder on the 12TH day of DECEMBER, 2013 at the hour of 10 AM of said day at the Brown County Sheriff's Department  the fee simple of the whole body of Real Estate in Brown County, Indiana:

A part of the East half of the Northwest quarter of Section 20, Township 9 North, Range 3 East and more particularly described as follow: Beginning at a point located 381.85 feet South of the Northeast corner of the Southeast quarter of the North west quarter of said Section 20 and running thence West 152.6 feet to a point; thence South 2 degrees 03 minutes West 340.8 feet to a point in the center of Old State Highway 46; thence North 45 degrees 02 minutes West along said highway center line 552.9 feet to a point which is 50.2 feet South 45 degrees 02 minutes East of the Southeast corner of the tract immediately adjoining on the West; thence North 33 degree 17 minutes East, parallel with the east line of said tract immediately adjoining on the West, 488.4 feet to a point; thence South 85 degrees 41 minutes East 288.8 feet to a point; thence South 436.9 feet to the place of beginning.  Containing 5.870 acres, more or less. Also an easement appurtenant to the above described land for all purposes, said easement being more particularly described as follow: A strip of land Fifty (50) feet wide, running North 33 degrees 17 minutes East from Old State Road 46 for a distance of 488.4 feet immediately adjacent to the West edge of said land.
