NOTICE OF SHERIFF'S SALE

By virtue of a certified copy of a decree to me directed from the Clerk of  the Circuit Court of Brown County, Indiana, in Cause No. 07C01-1301-MF-000012 wherein David Rauschenbach and Michelle Rauschenbach was Plaintiff, and Moondance Enterprises, LLC, State of Indiana, Brown County Area Board of Zoning Appeals, Brown County Area Plan Commission, Brown County, Indiana, and the Unknown Tenant, were Defendants, requiring me to make the sum as provided for in said Decree with interest and cost, I will expose at public sale to the highest bidder, on the 12 day of Dec., 2013, at the hour of 10 a.m., or as soon thereafter as is possible, at  the Brown County Sheriff's Department  55 State Rd. 46 East, Nashville, IN 47448, the fee simple of the whole body of Real Estate in, Brown County, Indiana.

A part of the West Half of the Northeast Quarter and a part of the East Half of the Northwest Quarter of Section 9, Township 9 North, Range 2 East of the Second Principal Meridian, Brown County, Indiana, more particularly described as follows:

Commencing at a U.S. Government concrete monument found at the Southeast corner of the Southwest Quarter of the Northeast Quarter of said Section; thence North 88 degrees 01 minutes 07 seconds West along the South line thereof a distance of 906.02 feet; thence North 09 degrees 45 minutes 00 seconds West a distance of 8.67 feet to the Southeast corner of a 10.2 acre tract recorded in Instrument Number 9800003464; thence continuing North 09 degrees 45 minutes 00 seconds West (reference bearing) a distance of 860.70 feet (deed and measured) to an iron pin found at a corner of said tract being the POINT OF BEGINNING; thence continuing along the East line of said tract the following three (3) calls: 1) North 17 degrees 57 minutes 00 seconds East a distance of 251.80 feet (deed and measured) to an iron pin found: 2) North 76 degrees 56 minutes 00 seconds West a distance of 208.40 feet (deed and measured) to an iron pin found: 3) North 44 degrees 16 minutes 00 seconds West a distance of 303.90 feet (deed and measured) to the center of Lanam Ridge Road; thence along the center of said road and the North line of a tract recorded in Book 173, pages 201-204 the following four (4) calls: 1) North 66 degrees 58 minutes 38 seconds East a distance of 127.44 feet; 2) North 50 degrees 30 minutes 48 seconds East a distance of 241.68 feet measured (242.0 feet deed); 3) North 35 degrees 27 minutes 18 seconds East a distance of 262.93 feet measured (264.4 feet deed); 4) North 44 degrees 30 minutes 17 seconds East a distance of 194.17 feet; thence South 29 degrees 24 minutes 06 seconds East a distance of 462.58 feet to an iron pin set; thence South 00 degrees 24 minutes 41 seconds East a distance of 531.61 feet to an iron pin set; thence South 71 degrees 26 minutes 07 seconds West a distance of 493.85 feet to the POINT OF BEGINNING, containing 10.5357 acres, more or less
