Washington Township taxpayers notice of indebtedness & authorization of loan




Notice is given to the taxpayers of Washington Township, Brown County, that on the 1st day of October, 2013 the Washington Township Board and Washington Township Trustee made a determination of need for an emergency fire loan in the amount of $200,000.00 for fire and emergency services within the jurisdiction served by the township pursuant to IC 36-6-6-14. Additionally, the legislative body issued a special order under section 14 of this chapter authorizing the executive to secure a loan in the same amount. Said loan is to be repaid in three (3) years. Repayment will begin with taxes 2013 payable 2014. Ten (10) or more taxpayers in the township objecting to this loan and special order may file a petition within 30 days of this notice with the Brown County Auditor stating their objections to the loan and special order and their reasons why the loan and special order is unnecessary or unwise.  If an objecting petition is filed, the County Auditor shall certify the petition, together with other data necessary to present the questions involved to the Department of Local Government Finance who shall hold a hearing on the matter in the county not less than five (5) or more than thirty (30) days after receipt of the certified petition from the County Auditor.  Notice of the hearing shall be provided by mail to the township and the first ten (10) taxpayers listed on the petition. Taxpayers present shall have the right to be heard. The final determination of the Department of Local Government Finance’s Special Order may be petitioned for judicial review by the Indiana Tax Court by the township or a taxpayer who signed the petition not more than 45 days after the issuance of the Special Order.
