PETITIONERS LEGAL NOTICE OF PUBLIC HEARING FOR:

REPLAT

AREA PLAN COMMISSION

Notice is hereby given that Luther Smith has filed with the Area Plan Commission of the County of Brown, Indiana an application for a Replat of two lots.

Legal description of premises:  A part of the Northwest quarter of the Northwest quarter, and a part of the Southwest quarter of the Northwest quarter, both being a part of Section 31, Township 10 North, Range 3 East, bounded and described as follows, to-wit: Beginning at a point 252.22 feet East and 585.75 feet South of the Northwest corner  of the Northwest quarter of the Northwest quarter of Section 31, Township 10 North, Range 3 East, also being described as being on the centerline of the Old Georgetown-Nashville Road; running thence South 17 degrees 1 minute 30 seconds West along and with the centerline a distance of 861.43 feet and to a  point on the West boundary of the Southwest quarter of the  Northwest quarter; thence running South 0 degrees East along and with said West boundary a distance of 1231.8 feet, more or less, and to the South boundary of said quarter quarter; thence running North 89 degrees 42 minutes East along and with said South boundary (and parallel to the North boundary of Section 31) a distance of 913.1 feet, more or less, and to the East boundary of said quarter quarter; thence running North 0 degrees East along and with the East boundary a distance of 514.3 feet to the West right of way of Indiana State Road No. 135; thence running North 20 degrees 42 minutes 30 seconds West and along the said West right of way a distance of 1647 feet, more or less, and to a point 587.39 feet South of the North boundary of the Northwest quarter of the Northwest quarter; thence running South 89 degrees 42 minutes West a distance of 89.39 feet and to the point of beginning, containing in all 30.5 acres, more or less, including 5 acres under easement to the Indiana Department of Conservation; said easement being recorded in Deed Record No. 46, on pages 375-377, in the office of the Recorder of Brown County, Indiana, EXCEPT THE FOLLOWING:

A part of the Northwest quarter of Section 31, Township 10 North, Range 3 East, more particularly described as follows: Beginning at a point of intersection of the West right of way of Indiana State Road No. 135 and the thread of Bean Blossom Creek, said point being described as 1503 feet South of the North boundary of said Northwest quarter section, running thence with the West right of way South 20 degrees 42 minutes 30 seconds East a distance of 666 feet to an iron pipe; thence running South 0 degrees West a distance of 514.3 feet to an iron pipe; thence running South 89 degrees 42 minutes West a distance of 340 feet to an iron pipe; thence running North 0 degrees East a distance of 520.9 feet; thence running North 41 degrees 59 minutes 52 seconds West a distance of 285 feet, more or less to the thread of Bean Blossom Creek; thence running in a Northeasterly direction along and with the meanderings of said Creek a distance of 490 feet, more or less, and to the point of beginning, containing in said EXCEPTION 8 acres, more or less; AND ALSO EXCEPT THE FOLLOWING DESCRIBED TRACT: A part of the Northwest quarter of Section 31, Township 10 North, Range 3 East of the Second Principal Meridian, Brown County, Indiana, more particularly described as follows: Beginning at a point in the thread of Bean Blossom Creek, said point being described 1285.5 feet South of the aforesaid Northwest corner of Section 31; thence continuing South 0 degrees East a distance of 532 feet to an iron pipe; thence running North 89 degrees 42 minutes East a distance of 573.1 feet to an iron pipe; thence running North 0 degrees East a distance of 520.9 feet; thence running North 41 degrees 59 minutes 52 seconds West a distance of 285 feet, more or less, to the thread of Bean Blossom Creek; thence running in a South¬westerly direction along and with the meanderings of said Creek a distance of 450 feet, more or less, and to the point of beginning, containing in said EXCEPTION 8 acres, more or less.

The property is located at 4837 Covered Bridge Road in Jackson Township.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

The Commission will hold a public hearing on October 22, 2013 during a meeting commencing at 6:00 p.m. All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. This notice is being published to notify persons affected by this petition by order of the Area Plan Commission. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing will be considered. The hearing may be continued from time to time. The meeting will be held in the second floor meeting room of the County Office Building, Nashville, Indiana.
