NOTICE OF SHERIFF’S SALE

     By virtue of a certified copy of a decree to me directed from the Clerk of the Circuit Court of Brown County, Indiana, in Cause No. 07C01-1212-MF-000636, wherein Fifth Third Mortgage Company was Plaintiff, and George A. Mathis Jr., Lori F. Mathis a/k/a Lori Mathis and George A. Mathis Sr., were the Defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 10th day of October, 2013, at 10:00 A.M. of said day, at the 55 State Road 46 East, Nashville, IN 47448, the fee simple of the whole body of Real Estate in Brown County, Indiana:

A part of the Southwest quarter of the Southwest quarter of Section 29, Township 10 North, Range 3 East, and more particularly described as follows: Beginning at a point located 250.0 feet East of the Southwest corner of said quarter quarter and running thence North 10 degrees 29 minutes West 70.0 feet to a point; thence North 89 degrees 31 minutes West 117.0 feet to a point in the center of a private road; thence North 15 degrees 05 minutes East 229.8 feet, along said road centerline, to a point; thence North 36 degrees 59 minutes East along said road centerline, 92.7 feet to a point; thence North 71 degrees 30 minutes East along said road centerline, 143.0 feet to a point; thence South 79 degrees 39 minutes East 711.5 feet to a point; thence South 297.0 feet to a point on the South line of said quarter quarter; thence North 89 degrees 31 minutes West 822.5 feet to the place of beginning, containing 5.23 acres, more or less. Together with rents, issues, income and profits thereof, said sale will be made without relief from valuation or appraisement laws.

Subject to all easements and restrictions of record not otherwise extinguished in the proceedings known as Cause # 07C01-1212-MF-000636 in the Circuit Court of the County of Brown Indiana, and subject to all real estate taxes, and assessments currently due, delinquent or which are to become a lien.

     Said sale will be made without relief from valuation or appraisement laws.  If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee's Attorney
