LEGAL NOTICE OF PUBLIC HEARING FOR A SPECIAL EXCEPTION

BROWN COUNTY BOARD OF ZONING APPEALS FOR TRAPP TOURIST HOME

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on July 24, 2013 at 6:00 p.m. in the second floor meeting room in the County Office Building.  The purpose of the meeting is to consider a petition by Mark Trapp and Luann Trapp for a Special Exception to allow a tourist home.

The location of the property is 4500 State Road 135 South in Van Buren Township.

Legal description of premises: Part of the Southeast quarter of the Northeast quarter and part of the Northeast quarter of the Southeast quarter of Section 15, Township 8 North, Range 3 East, Part of the Southwest quarter of the Northwest quarter and part of the Northwest quarter of the Southwest quarter of Section 14 Township 8 North, Range 3 East, all in Van Buren Township, Brown County, Indiana, described as follows: Commencing at a stone found marking the Northeast corner of the Southeast quarter of the Northeast quarter of said Section 15, said stone also marking the Northwest corner of the Southwest quarter of the Northwest quarter of said Section 14; thence North 85 degrees 40 minutes 22 seconds East (assumed bearing) on and along the North line of said Southwest quarter of the Northwest quarter 305.00 feet to a capped rebar set; thence South 00 degrees 14 minutes 02 seconds East 1335.96 feet to an iron pin set in the apparent center of the State Road Number 135; thence South 85 degrees 50 minutes 22 seconds West with the apparent center of said State Road 213.34 feet to an iron pin set and the point of beginning; thence continuing South 85 degrees 50 minutes 22 seconds West with the apparent center of said State Road 306.60 feet to an iron pin set; thence North 00 degrees 14 minutes 02 seconds West 290.00 feet to a capped rebar set; thence South 85 degrees 56 minutes 26 seconds West 282.41 feet to a capped rebar set; thence North 00 degrees 14 minutes 02 seconds West 423.43 feet to a capped rebar set; thence North 85 degrees 56 minutes 25 seconds East 109.87 feet to a capped rebar set; thence South 71 degrees 03 minutes 45 seconds East 298.37 feet to a capped rebar set; thence South 18 degrees 50 minutes 13 seconds East 615.06 feet to the beginning, containing 5.50 acres, more or less.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition.  Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered.  The hearing may be continued from time to time.  If you have a disability that requires special assistance for your participation in the meeting, please contact the Area Plan Commission office at (812) 988-5490.
