Attorney: Courthouse remonstrance process can continue

According to a county attorney, the Brown County Commissioners have not missed a deadline in furthering the remonstrance process.

Barnes & Thornburg’s Jeff Qualkinbush said Wednesday that the 30-day period for the commissioners to publish their chosen path in the remonstrance process doesn’t start until they make an official decision on it. Indiana Code says they have to give "notice of the applicability of the petition and remonstrance process."

Early interpretations of the code assumed that the date the county clerk certified the signatures on the first round of petitions was the starting date of the 30-day period for the commissioners to have made their decision and published their intent.

Signatures on those petitions, from citizens who object to the commissioners’ plan to take out a multimillion-dollar loan for a remodel and addition to the historic county courthouse, were certified May 22.

According to Commissioner Joe Wray, the board will likely make a decision on whether or not to proceed with the remonstrance during their first regular meeting next month, scheduled for 6 p.m. July 3 in the County Office Building.

The commissioners do have another public session scheduled before that at 9 a.m. June 27 in the County Office Building.

Confirmation from the Indiana Department of Local Government Finance on the remonstrance deadline structure is pending. Check back online this week or in the June 26 issue for further updates and additional details on the remonstrance process.
