LEGAL NOTICE OF PUBLIC HEARING

FOR CAGLE MINOR SUBDIVISION

BROWN COUNTY AREA PLAN COMMISSION

Notice is hereby given that the Brown County Area Plan Commission will hold a public hearing on May 28 2013 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Chantal Cagle to allow a 2 lot Minor Subdivision know as Cagle Minor Subdivision.

The location of the property is 4687 Yellowwood Road, Nashville, Indiana, in Washington Township

Legal description of premises: EXHIBIT "A

Part of the Southeast quarter of Section 32, Township 9 North, Range 2 East, Washington Township, Brown County, Indiana, described as follows: Commencing at a stone found marking the Northwest corner of the Southeast quarter of said Section 32; thence South 00 degrees 14 minutes 25 seconds West (assumed bearing) on and along the West line of said Southeast quarter 612.79 feet to an iron pin set in the apparent center of Yellowwood County Road; thence the following four (4) courses are with the apparent center of said County Road: North 87 degrees 39 minutes 41 seconds East 49.67 feet to an iron pin set, North 88 degrees 24 minutes 28 seconds'East 54.39 feet to an iron pin set, South 89 degrees 19 minutes 05 seconds East 464.79 feet to an iron pin set, and North 89 degrees 52 minutes 03 seconds East 93*07 feet to an iron pin set, and the beginning; thence the following four (4) courses are with the apparent center of said County Road: North 87 degrees 53 minutes 29 seconds East 186.53 feet to an iron pin set, South 88 degrees 17 minutes 10 seconds East 66.25 feet to an iron pin set, South 81 degrees 00 minutes 59 seconds East 57.78 feet to an iron pin set, and South 74 degrees 33 minutes 57 seconds East 136.63 feet to an iron pin set; thence the following four (4) courses are through the lands of Way described in Instrument Number 1999-3006 in the office of the Recorder of Brown County, Indiana: South 00 degrees 00 minutes 00 seconds West 800.00 feet to a capped rebar set, North 89 degrees 39 minutes 16 seconds West 476.84 feet to a capped rebar set, North 00 degrees 00 minutes 00 seconds East 500.00 feet to a capped rebar set, and North 05 degrees 59 minutes 26 seconds East 339.48 feet to the beginning, containing 9.004 acres, more or less.

The file on this matter is available for public inspection at least 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing will be considered. The hearing may be continued from time to time.
