LEGAL NOTICE OF PUBLIC HEARING FOR A SPECIAL EXCEPTION

BROWN COUNTY BOARD OF ZONING APPEALS FOR

 THE CHAD AND STEPHANIE WALTON TOURIST HOME

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on April 2, 2013 at 7:00 p.m. in the second floor meeting room in the County Office Building.  The purpose of the meeting is to consider a petition by Chad and Stephanie Walton for a Special Exception to allow a tourist home.

The location of the property is 4759 N. Morrison Road, Morgantown, Indiana, in Jackson Township.

Part of the Southeast quarter of the Northeast quarter of Section 35, Township 10 North, Range 2 East, Jackson Township, Brown County, Indiana, described as follows:  Commencing at the Northeast corner of the Southeast quarter of the Northeast quarter of said Section 35; thence South 00 degrees 46 minutes 42 seconds West (bearing from Silnes, Registered Land Surveyor No. S0304) on and along the East line of said Southeast quarter of the Northeast quarter 272.62 feet to the beginning; thence continuing South 00 degrees 46 minutes 42 seconds West on and along said East line 516.09 feet to a point 561.00 feet North of the Southeast corner of said Southeast quarter of the Northeast quarter, said point being the Northeast corner of a tract deeded to Clifford A. Arbuckle and Thelma M. Arbuckle and recorded in Deed Record No. 64, on page 557, in the office of the Recorder of Brown County, Indiana; thence North 89 degrees 38 minutes 48 seconds West 1344.76 feet to the Northwest corner of said Arbuckle tract in the West line of said Southeast quarter of the Northeast quarter; thence North 00 degrees 26 minutes 23 seconds East on and along  said West line 530.45 feet; thence South 76 degrees 49 minutes 57 seconds East 602.08 feet; thence North 81 degrees 27 minutes 02 seconds East 769.99 feet to the beginning, containing 14.203 acres, more or less.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered.  The hearing may be continued from time to time.  If you have a disability that requires special assistance for your participation in the meeting, please contact the Area Plan Commission office at (812) 988-5490.
