NOTICE OF SHERIFF'S SALE

By virtue of a certified copy of a decree to me directed from the Clerk of Brown Circuit Court of Brown County, Indiana, in Cause No. 07C01-1008-MF-0480 wherein The Bank of New York Mellon f/k/a The Bank of New York as Trustee for the Certificateholders of CWALT, Inc. Alternative Loan Trust 2006-12CB, Mortgage Pass-Through Certificates Series 2006-12CB was Plaintiff, and Roger Walton, Sharon D. Dawson, Capital One Bank (USA), N.A., f/k/a Capital One Bank and The Unknown Tenant were Defendants, required me to make the sum as provided for in said Decree with interest and cost, I will expose at public sale to the highest bidder, on the 10 day of January, 2013, at the hour of 10 a.m., or as soon thereafter as is possible, at Brown County Jail, 55 State Road 46 East, Nashville, IN  47448, the fee simple of the whole body of Real Estate in Brown County, Indiana.

A PART OF THE SE 1/4 OF SECTION 34, TOWNSHIP 10 NORTH, RANGE 3 EAST, DESCRIBED AS FOLLOWS:  BEGINNING AT THE SE CORNER OF THE SW 1/4 OF THE SE 1/4 OF SAID SECTION; THENCE RUNNING NORTH 1782 FEET, MORE OR LESS, TO A POINT IN THE CENTER OF THE PUBLIC HIGHWAY; THENCE NORTH 72 1/2 DEG. WEST ALONG THE CENTER OF HIGHWAY A DISTANCE OF 200 FEET, MORE OR LESS, TO A POINT; THENCE SOUTH 1841 FEET, MORE OR LESS, TO A POINT; THENCE EAST 178 3/10 FEET, MORE OR LESS, TO A POINT OF BEGINNING, CONTAINING 7.700 ACRES, MORE OR LESS.
