LEGAL NOTICE OF PUBLIC HEARING FOR

REZONING BROWN COUNTY AREA PLAN COMMISSION

Notice is hereby given that Penny Wright has filed with the Area Plan Commission of the County of Brown, Indiana, an application for Rezoning of property, to wit:

Legal description of premises: Lot No. 23, part of Lot No. 22 and Part of Lot No. 28 in ORCHARD HILL SUBDIVISION, SECOND ADDITION, Brown County, Indiana, described as follows: Beginning at the Southeast, corner of said Lot No. 23; thence South 36 degrees 22 minutes West 30.20 feet; thence North 43 degrees 58 minutes West 122.70 feet; thence North 47 degrees 12 minutes East 32.80 feet; thence North 42 degrees 30 minutes West 6.00 feet; thence North 46 degrees 14 minutes East 151.60 feet to the Westerly right-of-way of State Road No. 135; thence with said right of way South 44 degrees 44 minutes East 96.94 feet; thence South 36 degrees 48 minutes West 157.94 feet to the beginning, containing 0.47 of an acre.  Subject to easement for ingress and egress for service driveway over a 9-foot wide strip of ground located on Lot Nos. 22, 23 and 28, granted to Simon C. Acton, his heirs and assigns, dated October 27, 1970 and recorded November 2, 1970 in Miscellaneous Record No. 21, pages 214-215, in the office of the Recorder of Brown County, Indiana.

Applicant is requesting approval for rezoning the described property from Residential (R1) to Business (B3). The property is located at 1904 State Road 135 North in Washington Township.

The file on this  matter is available for public inspection at least 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

The Commission will hold a public hearing on November 13, 2012 during a meeting commencing at 6:00 p.m. All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. This notice is being published to notify persons affected by this petition by order of the Area Plan Commission. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing will be considered. The hearing may be continued from time to time. The meeting will be held in the second floor meeting room of the County Office Building, Nashville, Indiana.
