LEGAL NOTICE OF PUBLIC HEARING VARIANCE
BROWN COUNTY AREA BOARD OF ZONING APPEALS
Notice is hereby given that the Brown County Area Board of Zoning Appeals will hold a public hearing on October 24, 2012 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Scott Wayman for a variance of the setback for sign placement at the Little Nashville Opry.
Legal description of premises:
A part of the Southwest quarter of the Northwest quarter of Section 25 and a part of the Southeast quarter of the Northeast quarter of Section 26, all in Township 9 North, Range 2 East, bounded and described as follows: Beginning at a point that is 567.91 feet North and 93.48 feet West of the Southeast corner of the Southeast quarter of the Northeast quarter of said section 26, thence running North 63 degrees East for a distance of 153.20 feet, thence running South 70 degrees15 minutes East for a distance of 413.24 feet and to the West R/W line of State Road #46, thence running South 29 degrees 45 minutes West on and along said R/W line for distance of 100.0 feet, thence leaving said R/W line and running North 70 degrees 15 minutes West for a distance of 488.51 feet and to the place of beginning, containing 1.02 acres.
ALSO, A part of the Southwest quarter of the Northwest quarter of Section 25 and a part of the Southeast quarter of the Northeast quarter of Section 26, all in Township 9 North, Range 2 East, bounded and described as follows: Beginning at a point that is 567.91 feet North and 93.48 feet West of the Southeast corner of the Southeast quarter of the Northeast quarter of said section 26, thence running South 70 degrees 15 minutes East for a distance of 488.51 feet and to the West R/W line of State Road #46, thence running South 29 degrees 415 minutes West on and along said R/W line for a distance of 23.0 feet, thence continuing along said R/W line, South 25 degrees 30 minutes West for a distance of 77.0 feet, thence leaving said R/W line and running North 70 degrees 15 minutes West for a distance of 479.95 feet, thence running North for a distance of 75.81feet; thence running North 63 degrees East for a distance of 40.98 and to the place of beginning, containing 1.13 acres.
ALSO, A part of the Southwest quarter of the Northwest quarter of Section 25 and a part of the Southeast quarter of the Northeast quarter of Section 26, all in Township 9 North, Range 2 east, bounded and described as follows: Beginning at a point that is 240.54 feet North and 130.0 feet West of the Southeast corner of the Southeast quarter of the Northeast quarter of said section 26; thence running North for a distance of 232.95 feet; thence running South 70 degrees 15 minutes East for a distance of 479.95 feet and to the west R/W line of State Road #46; thence running on and along said R/W line the following courses; South 25 degrees 30 minutes West for a distance of 139.0 feet; South 21 degrees 15 minutes West for a distance of 36.0 feet and to the intersection of the centerline of a County Road, thence running on and along the center of said road the following courses; North 74 degree 53 minutes West for a distance of 351.80 feet; South 82 degrees 35 minutes west for a distance of 39.53 feet and to the place of beginning, containing 1.91 acres.

The file on this matter is available for public inspection 10 days prior to the hearing, during regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.
All interested persons will be given the opportunity to be heard in reference to the matters set out in the application. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
