LEGAL NOTICE OF PUBLIC HEARING FOR

THE HOLE'S MINOR SUBDIVISION

BROWN COUNTY AREA PLAN COMMISSION

Notice is hereby given that the Brown County Area Plan Commision will hold a public hearing on October 23, 2012 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Ronald and Linda Hole to allow a 2 lot Minor Subdivision.

The location of the property is 3220 E. State Road 46 in Washington Township.

Legal description of premises: Part of the West half of the Northwest quarter of Section 27, Township 9 North, Range 3 East described as follows:  Beginning South 42 degrees 28 minutes west 581.4 feet, South 02 degrees 30 minutes West 123.0 feet, South 34 degrees 15 minutes East 128.6 feet, South 17 degrees 02 minutes East 100.3 feet and South 12 degrees 20 minutes East 140.0 feet from the Northeast corner of said West half; thence with the center of a 30 foot wide easement South 12 degrees 20 minutes East 107.0 feet, South 12 degrees 32 minutes East 161.7 feet and South 04 degrees 34 minutes West 619.9 feet; thence North 85 degrees 37 minutes West with the North right of way of State Road #46 299.2 feet; thence North 03 degrees 41 minutes West 863.8 feet; thence South 89 degrees 14 minutes East 346.3 feet to the beginning, containing 6.98 acres more or less.

Including and subject to a 30 foot wide easement for ingress and egrees and for utilities located in the West half of the Northwest quarter of Section 27, Township 9 North, Range 3 East the centerline of which is described as follows:- Beginning South 42 degrees 28 minutes West 581.4 feet from the Northeast corner of said West half; thence South 02 degrees 30 minutes West 123.0 feet, South 34 degrees 15 minutes East 128.6 feet, South 17 degrees 02 minutes East 100.3 feet, South 12 degrees 20 minutes East 247.0 feet, South 12 degrees 32 minutes East 161.7 feet and South 04 degrees 34 minutes West 619.9 feet to the North Right of Way of State Road #46.

The file on this matter is available for public inspection at least 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing will be considered. The hearing may be continued from time to time.
