LEGAL NOTICE OF PUBLIC HEARING FOR A SPECIAL EXCEPTION

BROWN COUNTY BOARD OF ZONING APPEALS

FOR THE COMET INVESTMENTS TOURIST HOME

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on October 24, 2012 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Comet Investments for a Special Exception to allow a tourist home.

The location of the property is 5950 Crooked Creek Road in Washington Township.

Legal description of premises:

A part of the Southwest Quarter of the Southwest Quarter of Section 21 and a part of the Southeast Quarter of the Southeast Quarter of Section 20, all in Township 8 North Range 2 East, Brown County, Indiana, bounded and described as follows: Beginning at a point on the North line of the Southeast Quarter of the Southeast Quarter of Section 20, said POINT OF BEGINNING being 510 feet West of the northwest corner of the Southwest Quarter of the Southwest Quarter of Section 21; thence from said point of beginning and running South 68 degrees 37 minutes 15 seconds East for 548.36 feet and to a point dividing said Section 21 and 20, said point being South 00 degrees 13 minutes 39 seconds East 189.23 feet from the northwest corner of said Southwest Quarter of the Southwest Quarter of Section 21; thence with the center of a creek running South 39 degrees 54 minutes 55 seconds East 92.65 feet; thence South 20 degrees 55 minutes 05 seconds East 295.39 feet; thence South 13 degrees 50 minutes 15 seconds East 151.38 feet; thence South 34 degrees 05 minutes 20 seconds East for 152.05 feet; thence South 54 degrees 24 minutes 10 seconds East 215.20 feet and to the centerline of Crooked Creek Road; thence with the centerline of said road and running North 52 degrees 27 minutes 40 seconds West for 126.66 feet; thence South 70 degrees 37 minutes 30 seconds West for 407.20 feet; thence North 17 degrees 26 minutes 30 seconds West for 464.13 feet; thence North 51 degrees 18 minutes 50 seconds West for 1095.16 feet and to the North line of said Southeast Quarter of the Southeast Quarter of Section 20; thence with the North line of said quarter-quarter section and running South 88 degrees 48 minutes 03 seconds East for 596.5 feet to the point of beginning, containing 3.91 acres in Section 21 and 11.09 acres in Section 20 and containing in the total of the above described tract 15.00 acres, more or less.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
