LEGAL NOTICE OF PUBLIC HEARING

JOSHUA AND JESSICA WILLIAMS FOR A SPECIAL EXCEPTION

BROWN COUNTY BOARD OF ZONING APPEALS

Notice is hereby given that the Brown County Area Board of Zoning Appeals will hold a public hearing on September 26, 2012 at 6:00 p.m. in the second floor meeting room in the County Office Building.  The purpose of the meeting is to consider a petition by Joshua and Jessica Williams to allow a special exception for a home occupation to allow a pet boarding business.

The location of the property at 224 Salt Creek Road in Washington Township.

Legal Description:  A part of the Southeast quarter of Section 21, Township 9 North, Range 3 East, Brown County, Indiana, described as follows:

Beginning 55 rods North of the Southeast corner of the Southwest quarter of said Southeast quarter; thence South 59-1/2 degrees West with the County Road 165.0 feet; thence North 27 degrees 00 minutes West 205.3 feet; thence South 62 degrees 00 minutes West 117 feet; thence South 65-1/2 degrees West 86.3 feet; thence North 22-1/4 degrees West 232.5 feet; thence North 28-1/2 degrees East 235.4 feet; thence North 33-3/4 degrees West 36 feet; thence North 84 degrees 00 minutes East 268.6 feet; thence South 47 degrees 19 minutes East 509 feet; thence with the County Road South 34-1/4 degrees West 45 feet; and South 56 degrees 00 minutes West 212.5 feet to the beginning, containing 5.26 acres, more or less.

With the exception of any condition, covenant or restriction based on race, color, religion, sex, handicap, familial status, or national origin unless and only to the extent that said covenant (a) is exempt under Chapter 42, Section 3607 of the United State Code, or (b) relates to handicap, but does not discriminate against handicapped persons, the above described real estate is subject to a Blanket Easement for electric line and incidental purposes granted to Morgan County Rural Electric Membership Corporation, its successors and assigns, dated April 15, 1963 and recorded May 9, 1963 in Miscellaneous Record No. 15, page 124, in the Office of the Recorder of Brown County, Indiana, and to all other valid easments, restrictions, roadways and rights of way of record.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.
