NOTICE OF LAPSE OF INTEREST IN OIL AND MINERAL RIGHTS of ANNIE SUE MONTGOMERY

STATE OF INDIANA SS: COUNTY OF BROWN

IN RE: THE OIL AND MINERAL RIGHTS OF: 

ANNIE SUE MONTGOMERY AND HER HEIRS, SUCCESSORS AND ASSIGNS.

NOTICE OF LAPSE OF INTEREST IN OIL AND MINERAL RIGHTS

COMES NOW Drew R. Pattyn, fee owner of record of a parcel of real estate located in Brown County, State of Indiana more particularly described herein, by counsel, and hereby notifies Annie Sue Montgomery and her heirs, successors and assigns as follows:

1. That by Warranty Deed executed October 15, 1943 and recorded in the Office of the Recorder of Brown County, Annie Sue Montgomery did convey fee ownership of the following parcel of real property located in Brown County, Indiana, to Albert R. Johnson:

The South Half of the Northwest quarter of Section 11, Township 9 North, Range 3 East.

That in said Warranty Deed, Annie Sue Montgomery reserved for herself "all the oil and mineral rights of said lands."

 That Drew R. Pattyn is the successor in fee ownership interest in said real estate.

That the reservation of oil and mineral rights by Annie Sue Montgomery in said real estate has gone unused for a period of over 20 years. Upon information and belief, said reservation has never been used.

5.  That no Statement of Claim with respect to these oil and mineral rights has been filed with the Office of the Brown County Recorder by Annie Sue Montgomery or any other person.

6.  That accordingly, the oil and mineral rights of Annie Sue Montgomery and her heirs, successors and assigns in the real estate described herein have lapsed and expired by operation of law.
