PUBLIC HEARING FOR REZONING of: 1934 State Rd. 135 N.

LEGAL NOTICE OF PUBLIC HEARING FOR REZONING BROWN COUNTY AREA PLAN COMMISSION

Notice is hereby given that Big Woods Brewing Company LLC has filed with the Area Plan Commission of the County of Brown, Indiana, an application for Rezoning of property, to wit:

Legal description of premises:  A part of the Northeast quarter of Section 13, Township 9 North, Range 2 East (commonly called Lot No. 21 in Orchard Hill Subdivision), and a part of Lots No. 22 and 28 in Orchard Hill Subdivision, Second Addition, described as follows: Beginning North 44 degrees 44 minutes West 6.0 feet from an iron pin marking the intersection of the West right-of-way of State Road No. 135 and the South line of Lot No. 22 in said Orchard Hill Subdivision; thence South 46 degrees. 14 minutes West 151.6 feet; thence South 42 degrees 30 minutes East 6.o feet; thence South 47 degrees 12 minutes West 120.5 feet; thence North 42 degrees 30 minutes West 105.0 feet; thence North 45 degrees 23 minutes East 268.2 feet to the West right-of-way of State Road No. 135; thence South 44 degrees 44 minutes East 105.0 feet to the beginning. Grantors retain for themselves, their heirs and assigns a perpetual easement 20' x 20' located in the Northwest corner of above real estate for an entrance to other real estate owned by grantors. Also conveys a 9 foot wide easement located in Lots No. 22, 23 and 28 in said Orchard Hill Subdivision, Second Addition, lying to the left of the following described line: Beginning North 44 degrees 44 minutes West 6.0 feet from an iron pin marking the intersection of the West right-of-way of State Road No. 135 and the South line of Lot No. 22 in said Orchard Hill Subdivision; thence South 46 degrees 14 minutes West 151.6 feet; thence South 42 degrees 30 minutes East 6 feet; thence South 47 degrees 12 minutes West 120.5 feet to a iron pin.

Applicant is requesting approval for rezoning the described property from Residential (R2) to (B3).  The property is located at 1934 State Road 135 North in Washington Township.

The file on this matter is available for public inspection at least 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

The Commission will hold a public hearing on August 28, 2012 during a meeting commencing at 6:00 p.m. All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. This notice is being published to notify persons affected by this petition by order of the Area Plan Commission. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing will be considered. The hearing may be continued from time to time. The meeting will be held in the second floor meeting room of the County Office Building, Nashville, Indiana.
