PUBLIC HEARING FOR REZONING of: 1792 Old State Rd. 46

LEGAL NOTICE OF PUBLIC HEARING FOR REZONING BROWN COUNTY AREA PLAN COMMISSION

Notice is hereby given that Edward Ryan has filed with the Area Plan Commission of the County of Brown, Indiana, an application for Rezoning of property, to wit:

Legal description of premises: A part of the Southwest Quarter of the Southeast Quarter of Section 20, Township 9 North, Range 3 East, more particularly described as follows: Beginning at the Northeast corner of the Southwest quarter of the Southeast quarter of Section 20, Township 9 North, Range 3 East, thence South 3 Degrees East 213.5 feet to a point; thence South 10 degrees West 145 feet to a point, which is the point of beginning for the real estate herein described; thence South 10 degrees West 70 feet to a point; thence South 5-1/2 degrees East 45 feet to a point; thence South 12 degrees 45 minutes West 240 feet to the right-of-way of Indiana State Highway No. 135 and 46; thence following the said right-of-way in a Northwesterly direction 341 feet to a point; thence North 46-1/2 degrees East 58 feet to a point; thence North 77-1/2 degrees East 30 feet to a point; thence South 86-1/2 degrees East 75 feet to a point; thence North 62-1/2 degrees East 19.2 feet to a point; thence North 32-1/2 degrees East 20.8 feet to a point; thence North 1-1/2 degrees West 118 feet to a point; thence North 28 degrees West 32 feet to a point in an established drive way; thence South 76 degrees East 170 feet to the point of beginning, containing 1-1/2 acres, more or less.

Also, Beginning 15 feet East of the Northeast corner of the Southwest quarter of the Southeast quarter of Section 20, Township 9 North, Range 3 East, which point is in the center of a Twenty- foot-wide roadway; thence following the center of said roadway as described: South 3 degrees East 213.5 feet to a point; thence South 10 degrees West 237 feet to a point; thence South 5-1/2 degrees East 45 feet to a point, which point is the point of beginning for the tract of real estate described herein; thence East 10 feet to the East line of said quarter quarter, thence South along said East line 270 feet to a point on the North side of State Highway No. 46; thence along the North line of said State Highway No. 46 in a Westerly direction 90 feet to a point in the center of a twenty-foot-wide roadway; thence following the center of said twenty-foot-wide roadway North 12.45 degrees East 245 feet to the point of beginning, containing 1/4 of an acre, more or less.

Applicant is requesting approval for rezoning the described property from Residential (R1) to General Business (GB). The property is located at 1792 Old State Road 46 in Washington Township.

The file on this matter is available for public inspection at least 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

The Commission will hold a public hearing on June 26, 2012 during a meeting commencing at 6:00 p.m. All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. This notice is being published to notify persons affected by this petition by order of the Area Plan Commission. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing will be considered. The hearing may be continued from time to time. The meeting will be held in the second floor meeting room of the County Office Building, Nashville, Indiana.
