A PETITION TO VACATE A PUBLIC PARCEL
Comes now the owners, Archie and Tracy Johnson of the real estate abutting a dedicated alleyway more particularly described herein and, pursuant to Indiana Code § 36-7-3-12, petition for vacation of said dedicated alleyway. The legal description of the dedicated alleyway to be vacated is as follows, to wit:
A ten (10) foot wide alley located in Block Number 2, in the town of Helmsburg, Brown County, Indiana, according to the corrected plat as recorded in plat cabinet number one (1), Sleeve 270A in the Office of the Recorder of Brown County Indiana described as follows:
Beginning at the Northwest corner of lot number one (1) in said block number two 2, in the town of Helmsburg; Thence North 03 degrees 16 minutes 40 seconds East with the East edge of First Street 10.00 feet to the Southwest corner of lot number nineteen (19) in said block number two (2); thence leaving the East edge of said First Street south 88 degree 00 minutes 00 seconds east 178.05 feet to the Southeast corner of lot number seventeen (17) in said block number two (2) on the Southerly right of way on State Road 45; thence south 59 degrees 45 minutes 19 seconds east with said Southerly right of way 21.13 feet to the North line of lot number ten (10) in said block number two (2); thence leaving said Southerly right of way north 88 degrees 00 minutes 00 seconds West 196.88 feet to the beginning, containing 0.043 acre more or less (1874.2 square feet). More commonly known as the East-West alley behind the Helmsburg Laundry at 2349 State Road 45, Nashville, IN 47448 (Helmsburg)
The vacation of the alleyway as described herein would not injure public health, safety, or morals of the community, and the best use of the alleyway would allow it to be vacated.
