HAVEN HOLLOW MINOR SUBDIVISION

AREA PLAN COMMISSION

Notice is hereby given that Brian and Mary Burkhart has filed with the Area Plan Commission of the County of Brown, Indiana an application for a 2 lot Minor Subdivision.

Legal description of premises: A part of the Southeast quarter of the Southwest quarter of Section 9, Township 9 North, Range 3 East, Hamblen Township, Brown County, Indiana, described as follows:  Beginning at the Northwest corner of the Southeast quarter of the Southwest quarter of said Section 9; thence North 89 degrees 57 minutes 28 seconds East with the North line of said Southeast quarter of the Southwest quarter 500.05 feet to the center of Wallow Hollow County Road; thence with the center of said County Road: South 14 degrees 50 minutes 06 seconds East 184.74 feet, South 08 degrees 36 minutes 24 seconds West 149.94 feet and South 01 degree 44 minutes 24 seconds East 11.21 feet; thence North 90 degrees 00 minutes 00 seconds West 513.69 feet to the West line of said Southeast quarter of the Southwest quarter; thence North 01 degree 57 minutes 34 seconds West with said West line 337.84 feet to the beginning, containing 4.059 acres, more or less. With the exception of any condition, covenant or restriction based on race, color, religion, sex, handicap, familial status, or national origin unless and only to the extent that said covenant (a) is exempt under Chapter 42.  Section 3607 of the United State Code, or (B) relates to handicap, but does not discriminate against handicapped persons, the above described real estate is subject to the Easement for electric line and incidental purposes granted to Morgan County Rural Electric Membership Corporation, its successors and assigns, dated April 11, 1949 and recorded April 11, 1949 in Miscellaneous Record No. 11, page 68; to the Easement for electric line and incidental purposes granted to the Public Service Company of Indiana, Inc., its succssors and assigns, dated March 25, 1971 and recorded April 7, 1971 in Miscellaneous Record No. 22, pages 1749-181; to the Easement for water line and incidental purposes granted to Brown County Water Utility, Inc., its successors and assigns, dated May 10, 2006 and recorded May 25,  2006 as Instrument No. 2006-1938, all in the Office of the Recorder of Brown County, Indiana, and to all other valid easements, restrictions, roadways and rights of way of record.

The property is located at 2210 Wallow Hollow road in Hamblen Township.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

The Commission will hold a public hearing on March 27, 2012 during a meeting commencing at 6:00 p.m. All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. This notice is being published to notify persons affected by this petition by order of the Area Plan Commission. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing will be considered. The hearing may be continued from time to time. The meeting will be held in the second floor meeting room of the County Office Building, Nashville, Indiana.
