LEGAL NOTICE OF PUBLIC HEARING FOR A SPECIAL EXCEPTION BROWN COUNTY BOARD OF ZONING

APPEALS FOR THE RCS

HOLDINGS V, LLC. TOURIST HOME

 

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on November 16, 2011 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by RCS Holdings V, LLC. for a Special Exception to allow a tourist home.

 

The location of the property is 3717 Orchard Road in Van Buren Township. Legal description of premises:  Part of the north half of the southeast quarter of Section 22, Township 8 North, Range 3 East of the Second Principal Meridian. Van Buren Township, Brown County, Indiana described as follows: Commencing, at a stone found marking the southeast corner of the north half of the southeast quarter of said Section 22; thence south 87 degrees 36 minutes 16 seconds west (bearing from deed) on and along the south line of said north half, southeast quarter 1266.36 feet; thence north 00 degrees 00 minutes 00 seconds east 77.52 feet to a 5/8 inch rebar found marking the south corner of a tract described to Whitaker In deed record number 155, pages 203-203 on contract to S.M.I. Paragon in Instrument Number 2006-0934 in the Office of the Recorder of Brown County, Indiana; thence north 55 degrees 23 minutes 59 seconds' west with the westerly line of said S.M.I. Paragon 268.33 feet to a 5/8 inch capped rebar set and the beginning; thence the following two (2) courses are with said westerly line; thence North 55 degrees 23 minutes 59 seconds west 160.76 feet to a 5/8 inch rebar found and north 39 degrees 27 minutes 38 seconds west 171.65 feet to a 5/8 inch capped rebar set (stamped Bennett S0438); thence the following two (2) are through the lands of said S.M.I. Paragon: north 73 degrees 52 minutes 36 seconds East 596.64 feet to a 5/8 inch capped rebar set; (stamped Bennett S043S) and north 47 degrees 17 minutes 51 seconds east 531.05 feetto' a 2 inch mag nail w/aluminum disc set (stamped Bennett S0438) in the apparent center of Orchard Road; thence South 29 degrees 08 minutes 30 seconds east with the apparent center of said county road 150.00 feet to a 2 inch mag nail w/aluminum disc set (stamped Bennett S0438); thence leaving the apparent center of said county road the following four (4) courses are through the lands of said S.M.I. Paragon; south 67 degrees 32 minutes 46 seconds west 280.97 feet to a 5/8 inch capped rebar set (stamped Bennett S0438), south 12 degrees 35 minutes 37 seconds east 156.36 feet to a 5/8 inch capped rebar set (stamped Bennett S0438), south 18 degrees 57 minutes 11 seconds west 127.52 feet to a 5/8 inch capped rebar set (stamped Bennett S0438) and south 65 degrees 44 minutes 49 seconds west 579.23 feet to the beginning, containing 5.000 acres more or less.

 

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

 

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
