BROWN COUNTY AREA

BOARD OF ZONING APPEALS

Notice is hereby given that the Brown County Area Board of Zoning Appeals will hold a public hearing on November 16, 2011 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Norm and Sally Coulter for a variance to allow additional signage on the west side of the building at Big River.

Legal description of premises:

Part of the Southeast quarter of the Northwest quarter of Section 26, Township 9 North, Range 3 East, Brown County, Indiana, described as follows: Beginning at a stone marking the Northeast corner of said quarter quarter section; thence South 807.00 feet along the East line of said quarter section to the South right-of-way line of State Road No. 46; thence leaving said East line South 85 degrees 33 minutes 06 seconds West 507.82 feet along said right-of-way line to the true point of beginning; thence leaving said right-of-way line South 01 degree 22 minutes 34 seconds West 220.00 feet; thence South 85 degrees 33 minutes 06 seconds West 204.00 feet; thence North 01 degree 22 minutes 34 seconds East 220.00 feet to the South right-of-way of State Road No. 46; thence North 85 degrees 33 minutes 06 seconds East with said right-of-way 204.00 feet to the beginning.

Containing 1.025 acres, more or less.

Subject to:

Easement for gas line and incidental purposes granted to Indiana Natural Gas Corporation, its successors and assigns, dated August 8,1968 and recorded January 24,1969 in Miscellaneous Record No. 19, page 347.

Easement for telephone line and incidental purposes granted to Indiana Bell Telephone Company, Incorporated, its successors and assigns, dated September 21,1971 and recorded January 12, 1972 in Miscellaneous Record No. 23, page 40.

3. All other easements, restrictions, covenants and all other matters of record. The property is located at 4413 State Road 46 East in Washington Township

The file on this matter is available for public inspection 10 days prior to the hearing, during regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the application. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
