Local man charged with felony neglect of children

A Brown County man has been charged with two felonies after police say he inhaled a can of compressed air and scared the children, causing them to run to a neighbor’s house.

Police responded to a home in the 5800 block of State Road 46 East on Aug. 12 for a report of a dispute, according to a report by Brown County Sheriff’s Deputy Josh Stargell.

Deputy William Pool spoke with the children, who had run to a neighbor’s house. They said they saw Robert Waggoner, 37, holding an air duster in his mouth and squeezing the handle.

When the officers went to speak with Waggoner, he appeared to be intoxicated, with unsteady balance, slurred speech and an “abusive attitude,” the report said. Stargell wrote that at times it was “close to impossible” to understand what Waggoner was saying.

Pool said there was an air duster in his waistband. Waggoner told the deputies it was for cleaning his Xbox and Playstation. Stargell reported the air duster was “ice cold” and that happens if it is sprayed upside down.

When the deputies asked where the children were, he said they were with their mother.

Waggoner told Nashville Police Office Keith Lawson that he had been drinking beer, the report said. When Stargell told him he could not smell alcohol on him, Waggoner stepped a few feet away from Lawson and blew in his face with a combination of spit and breath.

Lawson confronted Waggoner about spitting in his face. The officer put him in an arm lock and Waggoner was placed in handcuffs, the affidavit states.

The children told the police that when their mother left the home, Waggoner called them into the kitchen where he was holding the can of air duster in his mouth and inhaling it, according to the affidavit. One of the children said that Waggoner went into the living room where he fell into the television and began falling down “everywhere.”

During a search of the home, Stargell reported finding a second air duster can under an area rug that was also “extremely cold.” Security footage from CVS Pharmacy in Nashville showed Waggoner buying three cans. Officers didn’t find the third can. The Playstation was still covered with a layer of dust, the report said.

Waggoner tried to pull away from deputies as he was being placed in a patrol car. He continued to yell profanities and jerk away from deputies while at the Brown County jail. He was placed into a padded cell in a restraint chair, the report said.

He was charged Aug. 13 with two counts of neglect of a dependent, Level 6 felonies; resisting law enforcement, a Class A misdemeanor; and inhaling toxic vapors, a Class B misdemeanor.
