Man charged with felony after crashing ATV

CORDRY-SWEETWATER — An Indianapolis man has been charged with a felony after crashing an all-terrain vehicle that he did not have permission to ride in August.

Police responded to the ATV crash in the 8700 block of Nineveh Road on Aug. 13 at around 4 p.m. They found Christopher R. Oder, 38, unconscious next to the wrecked ATV, according to a probable cause affidavit by Indiana Department of Natural Resources Conservation Officer Joseph Tenbarge.

Oder was riding a Polaris Sportsman that he had taken for a ride without permission from a nearby home. The owner wanted to press charges after he crashed it, according to the prosecutor’s office.

Tenbarge reported that Oder had a head injury.

EMS personnel reported to Tenbarge that Oder smelled like alcohol. Tenbarge was unable to get a chemical test at that point due to Oder being unconscious and injured, according to the affidavit. A chemical test was done later that night and showed Oder’s blood-alcohol content to be 0.13. The legal limit for a driver is 0.08.

Oder was charged Dec. 6 with one count of Level 6 felony theft and operating a vehicle while intoxicated — endangering a person, a Class A misdemeanor.

Tenbarge estimated the damage to the ATV to be $10,000. The ATV was valued between $750 and $50,000, which elevated Oder’s theft charge to a Level 6 felony.
