Couple charged with drug offenses

A couple was issued summonses for possession of marijuana and paraphernalia in Brown County while on their way back from vacation.

Brown County Sheriff’s Deputy Joshua Stargell stopped a vehicle driven by Brandon Wright, 25, of Bloomington. He was driving 56 mph in a 40 mph zone on State Road 46 West near Town Hill Road, at around 1:21 a.m. Oct. 7, Stargell’s report said.

Wright told Stargell that he, Emily C.T. Hernandez, 25, and his 1-year-old son were on their way back from Gatlinburg, Tennessee.

After issuing Wright a warning for speeding, Stargell returned to the vehicle and reported smelling a strong odor of marijuana, as if it had been smoked in recently, the report said.

Wright and Hernandez both denied having marijuana inside the vehicle. Stargell searched it. Hernandez told police she was pregnant and asked what the probable cause was for the search before exiting the vehicle, the affidavit states.

When Stargell opened the driver’s front door, he found a glass smoking pipe with burnt marijuana in the door pocket. Wright said he did not know the pipe was in the door, but Stargell noted that Wright’s cellphone with GPS on it was also in the door pocket, the report said.

In the ashtray, Stargell reported finding a grinder with a small amount of marijuana inside.

Sgt. Bill Southerland, with the sheriff’s department, reported finding a wooden one-hitter on top of other items in Hernandez’s purse.

The couple was issued summonses and both were released. They were both charged Nov. 13 with misdemeanors.
