UPPER MARLBORO, Md. — A judge says a man can move forward with suing several Prince George’s County police officers who shot him to stop a car he was riding in.
The Daily Record of Baltimore (http://bit.ly/2d8Ncrf ) reports that Darren Kevin Jones says police used excessive force in April 2014 after responding to a woman’s report that her boyfriend, Carlos Barksdale, was kicking in her garage door.
Jones was inside the car when police said Barksdale drove away and struck Officer Gary Allen, prompting Allen to shoot. Jones and Barksdale say the car never touched Allen.
A judge last week denied the officers’ motion for summary judgment on the excessive force count, ruling that a reasonable jury could find the officers fired on the car out of retribution rather than safety concerns.
