BROWN COUNTY BOARD OF ZONING APPEALS

FOR ELY TOURIST HOME

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on July 27, 2016 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Jon Ely for a Special Exception to allow a tourist home.

The location of the property is 4686 Petro Road, Nashville, Indiana, in Hamblen Township.

Legal description of premises:

TRACT 1

A part of me Northeast Quarter of Section 35, Township 10 North, Range 3 East of the Second Principal Meridian, Hamblen Township, Brown County, Indiana, more particularly described as follows:

Commencing at the northwest comer of said Quarter Section; thence North 88 degrees 28 minutes 09 seconds East on and along the North line thereof a distance of 344.28 feet to the POINT OF BEGINNING; thence continuing Norm 88 degrees 28 minutes 09 seconds East on and along the North line a distance of 687.50 feet; thence South 12 degrees 37 minutes 10 seconds West a distance of 596.91 feet to the center of the county road; thence along the county road the following six (6) calls:

1) North 59 degrees 21 minutes 30 seconds West a distance of 214.59 feet;

2) North 46 degrees 14 minutes 06 seconds West a distance of 84.81 feet;

3) North 44 degrees 08 minutes 45 seconds West a distance of 112.68 feet;

4) North 23 degrees 27 minutes 53 seconds West a distance of 147.80 feet;

5) North 36 degrees 14 minutes 57 seconds West a distance of 124.61 feet;

6) North 51 degrees 37 minutes 11 seconds West a distance of 127.51 feet to the point of beginning containing 5.004 acres, more or less.

A part of the Northeast Quarter of Section 35, Township 10 North, Range 3 East of the Second Principal Meridian, Hamblen Township Brown County, Indiana, more particularly described as follows:

Commencing at the northwest comer of said Quarter Section thence North 88 degrees 28 minute 09 seconds East on along the North line thereof distance of 1031.78 feet to the POINT OF BEGINNING; thence continuing North 88 degrees 28 minutes 09 seconds East on and along said North line a distance of 272.90 feet; thence South 00 degrees 00 minutes 00 seconds East a distance of 646.57 feet to the center of the county road; thence along the county road the following two (2)   calls:

1) South 88 degrees 23 minutes 46 seconds West a distance of 248.97 feet;

2) thence North 67 degrees 33 minutes 19 seconds West a distance of 166.99 feet; thence North 12 degrees 37 minutes 10 seconds West a distance of 596.61 feet to the point of beginning, containing 5.000 acres, more or less.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
