Notice is hereby given that Timothy Barr and Beth Barr, Petitioners, have filed with the Board of Zoning Appeals of the County of Brown, Indiana, an application for variation in the regulations of the Zoning Ordinance, to wit:
Legal description of premises:
Part of the West Half of the Southwest Quarter of Section 24, Township 8 North, Range 3 East of the Second Principal Meridian, Van Buren Township, Brown County, Indiana, described as follows: Commencing at a sandstone found marking the southwest corner of the West Half of the Southwest Quarter of said Section 24; thence North 00 degrees 22 minutes 13 seconds West (basis of bearing) on and along the West line of said West Half, Southwest Quarter 725.00 feet to a capped rebar found and the beginning; thence continuing North 00 degrees 22 minutes 13 seconds West on and along said West line 869.06 feet to a rebar found; thence South 79 degrees 19 minutes 13 seconds East 567.93 feet to a capped rebar found; thence South 01 degree 19 minutes 14 seconds West 560.11 feet to a capped rebar found; thence South 90 degrees 00 minutes 00 seconds East 419.00 feet to a mag nail found in the center of Christiansburg County Road; thence the following Two (2) courses are with the center of said county road; South 01 degree 51 minutes 06 seconds West 150.00 feet and South 00 degrees 58 minutes 01 second West 5.53 feet to a mag nail found; thence leaving the center of said county road South 87 degrees 05 minutes 44 seconds West 954.86 feet to the beginning, containing 11.677 acres, more or less.
SUBJECT TO and right of a Fifty (50) foot wide perpetual non-exclusive easement for ingress, egress, roadway and utilities located in part of the Southwest Quarter of the Southwest Quarter of Section 24, Township 8 North, Range 3 East of the Second Principal Meridian, Van Buren Township Brown County, Indiana, lying to the left of the following described line: Commencing at the southwest corner of the Southwest Quarter of the Southwest Quarter of said Section 24; thence North 00 degrees 22 minutes 13 seconds East on and along the West line of aid Southwest Quarter, Southwest Quarter 725.00 feet to the POINT OF BEGINNING for the Fifty (50) foot wide easement herein described; thence North 87 degrees 05 minutes 44 seconds East 954.44 feet to the center of Christiansburg County Road and the terminus of said Fifty (50) foot wide easement.
Applicants are requesting a Special Exception to operate a Commercial Greenhouse. The property is located at 5868 Christiansburg Road in Van Buren Township.
The file on this matter is available for public inspection during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana, until two days prior to the hearing date.
A public hearing will be held by the Board on July 27, 2016, during a meeting commencing at 6:00 p.m. All interested persons will be given the opportunity to be heard in reference to die matters set out in the application. This notice is being published to notify persons affected by this application by order of the Area Board of Zoning Appeals. Written comments regarding die petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time. The meeting will be held in the second floor meeting room of the County Office Building, Nashville, Indiana.
