Notice is hereby given that the Brown County Area Board of Zoning Appeals will hold a public hearing on April 27, 2016 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by John Myers for approval of an application for a front setback Variance.

Legal description of premises:

Part of the Northeast Quarter of the Southwest Quarter of Section 21, Township 9 North, Range 3 East of the Second Principal Meridian, Washington Township, Brown County, Indiana described as follows: Commencing at a sandstone found marking the northeast corner of the Northeast Quarter of the Southwest Quarter of said Section 21; thence North 90 degrees 00 minutes 00 seconds West (bearing from deed) on and along the North line of said Northeast Quarter, Southwest Quarter 330.80 feet to a 3/4 inch (inside diameter) iron pipe found; thence South 03 degrees 37 minutes 50 seconds West 808.00 feet to a 5/8 inch rebar found and the BEGINNING; thence South 89 degrees 59 minutes 55 seconds East 241.58 feet to a 5/8 inch rebar found; thence South 15 degrees 28 minutes 59 seconds West 220.52 feet to a 3/4 inch (inside diameter) iron pipe found; thence South 01 degrees 19 minutes 00 seconds West 272.88 feet to a 5/8 inch capped rebar (stamped Bennett S0438) found; thence North 86 degrees 18 minutes 50 seconds West 152.43 feet to a railroad spike set in the center of an existing thirty (30) foot wide easement; thence North 04 degrees 00 minutes 25 seconds East with the center of said easement 238.59 feet to a railroad spike set; thence leaving the center of said easement North 89 degrees 59 minutes 55 seconds West 56.07 feet to a 5/8 inch capped rebar (stamped Bennett S0438) found; thence North 03 degrees 37 minutes 50 seconds East 238.00 feet to the beginning, containing 2.00 acres more or less.

TOGETHER WITH and SUBJECT TO A NON-EXCLUSIVE, PERPETUAL EASEMENT 24-feet in width for ingress and egress located in the East Half of the Southwest Quarter of Section 21, Township 9 North, Range 3 East, with a centerline described as follows: Beginning at a point located 1550.4 feet South and 397.0 feet West of the Northeast Quarter of said half quarter; and running thence South 05 degrees 08 minutes West 500.0 feet to a point; thence South 12 degrees 04 minutes East 55.4 feet to a point; thence South 09 degrees 31 minutes West 271.1 feet to a point; thence South 01 degree 08 minutes West 260.7 feet to a point; thence South 11 degrees 51 minutes West 56.4 feet to the North line of Old Highway No. 46, and the place of ending.

The property is located at 303 N. Walls Road in Washington Township.

The file on this matter is available for public inspection 10 days prior to the hearing, during regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

All interested persons will be given die opportunity to be heard in reference to the matters set out in the application. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
