SPECIAL EXCEPTION AREA BOARD OF ZONING APPEALS

Notice is hereby given that the Brown County Board of Zoning Appeals will hold a public hearing on February 24, 2016 at 6:00 p.m. in the second floor meeting room in the County Office Building. The purpose of the meeting is to consider a petition by Mitch and Dova Dickerson for a Special Exception to allow a tourist home.

The location of the property is 8079 Rinnie Seitz Road in Washington Township.

Legal description of premises:

Lot No. 4, Ridgewood Subdivision, as recorded May 25, 2000 in Plat Cabinet No. 1, Sleeve 322, as Instrument No. 2000-2051, in the office of the Recorder of Brown County, Indiana, containing 5.304 acres, more or less.

ALSO, a perpetual, Non-Exclusive Easement 50 feet in width for ingress, egress and utilities set forth in Instrument entitled “Perpetual, Non-Exclusive Easement For Roadway and Utility Purposes” recorded December 2, 2005 as Instrument No. 2005-4968.

ALSO, a perpetual. Non-exclusive Easement for ingress, egress and utilities 50 feet in width as shown on plat of Ridgewood Subdivision recorded May 25, 2000 in Plat cabinet No. 1, Sleeve 322, as Instrument No. 2000-2051.

With the exception of any condition, covenant or restriction based on race, color, religion, sex, handicap, familial status, or national origin unless and only to the extent that said covenant (a) is exempt under Chapter 42, Section 3607 of the United State Code, or (b) relates to handicap, but does not discriminate against handicapped persons, the above described real estate is subject to the terms, provisions, building set back lines and easements set forth in Ridgewood Subdivision Secondary Plat recorded May 25, 2000 in Plat Cabinet No. 1, Sleeve 322, as Instrument No. 2000-2051; to the covenants and restrictions pertaining to Ridgewood Subdivision as recorded in Warranty Deed to Timothy S. Fields and Annette M. Fields, husband and wife, recorded December 2, 2005 as Instrument No. 2005-4966; to the terms and provisions set forth in instrument entitled “Perpetual, Non-Exclusive Easement For Roadway and Utility Purposes,” dated November 30, 2005 and recorded December 2, 2005 as Instrument No. 2005-4968; to the terms, conditions, provisions and limitations pertaining to the classification of the real estate as forest recorded January 15, 2010 as Instrument No. 2010-116, all in the Office of the Recorder of Brown County, Indiana, and to all other valid easements, restrictions, roadways and rights of way of record.

The file on this matter is available for public inspection 10 days prior to the hearing, during the regular working hours at the Brown County Area Plan Commission office in the County Office Building, Nashville, Indiana.

All interested persons will be given the opportunity to be heard in reference to the matters set out in the petition. Written comments regarding the petition, which are filed with the secretary of the Area Plan Commission before the hearing, will be considered. The hearing may be continued from time to time.
